He thought that he had all the required paperwork, and set up shop for the June 14 concert in Jubilee Park. However, the city dis- agreed, and ordered him to stop immediately. In a June 19 letter, City Recorder Jim Polk took Moore to task for failing to obtain the city’s permission for the barbecue. “It has come to the atten- tion of the City of Cave Junction that you are con- ducting business inside the city limits without a business license,” Polk wrote. “You are required to cease this activity immediately or to obtain the necessary authori- zation and licensing from the City, Josephine County and State of Oregon (as required) prior to engaging in any fu- ture activity.” During a telephone inter- view, Moore said that he wasn’t expecting the city to react in such a manner. “I was a bit surprised, to say the least,” Moore said. “I think the letter was definitely over the top and premature. Moore said that the chamber of commerce, for which his mother is office manager, had asked him to conduct the fund-raiser. The intent, besides raising money for the youth group, was to make food available during the Thursday 6:30 to 8:30 p.m. al fresco, free concerts for the community. The chamber had per- mission to sponsor and sanc- tion the Concerts in the Park series. But Polk said that food sales were not included in the agreement. “All that the chamber asked for was to rent the ‘amphitheater’ and use sound,” Polk said. “They didn't say anything about selling food.” Seeking to resolve the issue, Moore appeared dur- ing the Cave Junction City Council’s Monday night, June 25 meeting in city hall. Moore told the council- ors that he had a letter from the chamber requesting that he be allowed to continue vending during the concert series. He promised to set up outside the handicapped area and park only in designated areas. He added that he has a food handler’s permit. That was good enough for the council, which voted 3-0 to grant Moore permis- sion to continue the fund- raiser. Mayor Tony Paulson and councilors Margaret Miller and Russell Ehrman voted in favor. Councilors Dan Fiske and Lynne Atte- berry were absent. The council also voted unanimously to allow Farm- ers Insurance Agent Irene Guerrero-Acevedo to operate her business from her Palmer Street residence. Acevedo said that she will move the home’s garage to the rear of the lot to make room for additional parking spaces. She promised to pave the approach to the property. The council unani- mously voted to adopt its supplemental budget for the 2006-07 fiscal year, as well as the budget for the 2007-08 fiscal year. In another matter, a set- tlement offer was made to James Huguley, an Alaska resident who owns property at 126 Caves Hwy. Huguley’s property had incurred an abatement judg- ment of $155,500, including approximately $4,000 in le- gal and administrative costs to the city. The city had of- fered to settle the judgment for 10-cents on the dollar, for a total of $15,500. Huguley’s attorney, Bill Ransom, made a counter-offer of $9,000. Miller moved to offer a judgment settlement of $12,000. That motion passed 2-1 with the mayor -- seek- ing $15,000 -- voting “No.” The council also held a public hearing on an ordi- nance to establish the posi- tion of code enforcement officer for the city. Thursday, June 21 *After leaving his ‘97 pickup truck along Reeves Creek Road the night before, when it ran out of fuel, a man returned today to retrieve it. He found an estimated $1,500 damage apparently caused by a clever fellow with a bat. *Continuing vandalism and second-degree criminal mischief were reported at Pomeroy Estates at the end of Schumacher Street after someone cut a gate lock. *Identity theft involving items ordered from a catalog by her daughter were complained about by a mother on Old Stage Road. *A man “being erratic” was the subject of several complaints in Selma.
