TRUSTEE’S NOTICE OF SALE
The obligations secured by the Trust Deed
described in this notice are in default and the
beneficiary has elected to foreclose the Trust
Deed pursuant to ORS 86.705 through ORS
86.795. No action is currently pending to re-
cover any part of the debt secured by the Trust
Deed.
The following information is given pursuant
to ORS 86.735 and ORS 86.745:
1. TRUST DEED: The Trust Deed was exe-
cuted by MICHAEL A. COLLINS as Gran-
tor; to FIRST AMERICAN TITLE INSUR-
ANCE COMPANY OF OREGON as Trus-
tee; MANSFIELD R. CLEARY was ap-
pointed as Successor Trustee on January
11, 2007, Instrument #2007-000685; for
the benefit of BRUCE E. PALMER AND
SALWA PALMER, TRUSTEES OF THE
PALMER FAMILY TRUST, u.a.d. May 28,
1991, as Beneficiary. The Trust Deed is
dated February 20, 2002 and was re-
corded March 1, 2002 as Document No.
2002-004783, Official Records of Jose-
phine County, Oregon.
2. PROPERTY: The property encumbered
by the Trust Deed is situated in Josephine
County, Oregon and particularly described
as follows:
Lot 2, SHADOW BROOK ESTATES,
Josephine County, Oregon
3. DEFAULTS: This foreclosure is a result of
the following defaults: Failure to pay
monthly
installments
of
$494.84 each, falling due on October 1,
2006 and on the 1st day of each month
thereafter.
4. BALANCE OWING: The following sums
are owing on the obligation secured by the
Trust Deed:
• The entire unpaid principal balance of
$49,824.65 with interest thereon at the
rate of 9% annum from September 18,
2006 until paid.
• $50.00 per month late penalty charges
for January and May 2005, June through
December 2006, for a total of 9 months
of late penalty charges, which total
$450.00;
• $727.36 for the 2006/2007 property
taxes, plus interest and penalties, if any;
• Title expenses of $360.00, recording
costs of $145.00, service costs, publica-
tion costs, trustee’s fees, and $1,500.00
for attorney’s fees incurred herein by
reason of said default; and any further
sums advanced by the beneficiary for the
protection of the above-described real
property and beneficiary’s interest
therein.
• Any other defaults which may exist prior
to the foreclosure sale not hereinabove
mentioned for the protection of the
above-described real property and bene-
ficiary’s interest therein.
5. ELECTION TO SELL: As a result of the
defaults set out above, the beneficiary and
the trustee have elected to sell the prop-
erty to satisfy the obligations secured by
the Trust Deed. A Notice of Default has
been recorded pursuant to ORS 86.735
(3) and the beneficiary has declared all
sums owing on the obligations secured by
the Trust Deed immediately due and pay-
able.
6. SALE: The Property will be sold in the
manner prescribed by law on Monday,
June 4, 2007 at 2:00 p.m. in accord with
the standard of time established by ORS
187.110, at the office of Mansfield R.
Cleary, 200 West Lister Street, Cave
Junction, Josephine County, Oregon.
7. RIGHT TO CURE DEFAULT UNDER
ORS 86.753: Any person named in ORS
86.753 has the right, at any time prior to
five days before the date last set for the
sale, to have this foreclosure proceeding
dismissed and the Trust Deed reinstated
by payment to the beneficiary of the entire
amount then due (other than the portion of
the principal that would not be due had no
default occurred) together with costs and
expenses actually incurred in enforcing
the obligations, including trustee’s and
attorney’s fees and any sums advanced
by the beneficiary pursuant to the Trust
Deed and by curing any other default
complained of herein that is capable of
being cured by tendering the performance
required under the note and Trust Deed.

NOTICE OF MEASURE ELECTION
NOTICE IS HEREBY GIVEN that on Tuesday,
May 15, 2007 an election will be held within
the boundaries of Josephine County, Oregon.
The election shall be conducted by mail. The
following question will be submitted to the
qualified voters thereof:
THREE YEAR LOCAL OPTION TAX FOR
CRIMINAL JUSTICE SYSTEM OPERATIONS
QUESTION: Should Josephine County impose
$2.496 per $1,000 of assessed value for crimi-
nal justice system operations for three years
beginning 2007-2008? This measure may
cause property taxes to increase more than
three percent.
SUMMARY: This measure may be passed
only at an election with at least a 50 percent
voter turnout.
The County would use the revenue from this
measure to provide funding for three years to
the Josephine County Criminal Justice System
agencies: the Sheriff’s Office; the Juvenile
Justice Division; and the District Attorney’s
Office. The revenue from this measure would
provide funding levels for criminal justice op-
erations following the loss of federal funding
historically derived from O&C timber lands.
Federal funding to the county to replace the
O&C monies ended in 2006. Without the reve-
nue provided by this measure, Josephine
County would reduce the number of Sheriff
deputies; close the juvenile shelter facility; and
reduce staffing levels in the District Attorney’s
Office.
It is estimated that the proposed rate will raise
approximately $13,481,000 in fiscal year 2007-
2008; $14,263,000 in fiscal year 2008-2009;
and $14,904,000 in fiscal year 2009-2010, for
a total of $42,648,000. The approximate tax
increase for a home with an assessed value of
$125,000 would be $312 per year, or approxi-
mately $26 per month. The revenue from this
measure would be used for criminal justice
system operations only.
The estimated tax cost for this measure is an
ESTIMATE ONLY based on the best informa-
tion available from the county assessor at the
time of estimate.
Any person dissatisfied with the ballot title may
petition the Circuit Court Pursuant to ORS
250.195, by February 26, 2007.
