Criteria for obtaining Oregon commercial driver license becomes much more difficult
Oregon is tightening the
requirements for people who
are employed to drive com-
mercial vehicles -- both in
obtaining and keeping those
driving privileges.
When Congress passed
the Motor Carrier Safety Im-
provement Act of 1999, it set
new requirements and stan-
dards for commercial motor
vehicle drivers. States had to
comply with these heightened
safety regulations by Sept. 30,
and the 2005 Oregon Legisla-
ture adopted the changes un-
der House Bill 2107.
“With the passage of HB
2107, these changes bring
Oregon into compliance with
federal Motor Carrier Safety
Administration (MCSA)
safety rules,” said Valerie
Schoenfeldt, DMV imple-
mentation manager. To meet
the federal requirements,
DMV adopted the following:
*Depending on the num-
ber of offenses, commercial
drivers can be suspended for
one to five years, or even life.
These offenses include being
under the influence of alcohol
or a controlled substance;
having a blood alcohol con-
tent of 0.04 or greater while
operating a commercial mo-
tor vehicle; or refusing to take
an alcohol test as required
under implied consent laws.
*New traffic violations
that may result in commercial
driver/license (CDL) suspen-
sions include operating a
commercial motor vehicle
without appropriate driving
privileges or operating a com-
mercial motor vehicle without
a CDL in the driver’s posses-
sion.
*A new failure-to-appear
or failure-to-comply suspen-
sion of an Oregon CDL if
ordered by another state when
the offense is a traffic viola-
tion that would lead to sus-
pension if it occurred in Ore-
gon.
*MCSA can notify
DMV that a driver is disquali-
fied from operating a com-
mercial motor vehicle be-
cause he or she has been de-
termined to be an imminent
hazard.
*Courts are not allowed
to offer diversions to keep
tickets from appearing on
driving records when the per-
son has a CDL or was operat-
ing a commercial motor vehi-
cle at the time they got the
ticket.
For example, a court can
no longer authorize an alco-
hol diversion for DUII, if the
person has a CDL or was
operating a commercial mo-
tor vehicle at the time the
offense was committed.
*Drivers must now pass
school bus skills and knowl-
edge tests to obtain a school
bus endorsement.

*Subsequent to a physi-
cal altercation on W. River
Street at 4 p.m. in which
some people allegedly
ripped a door off a car in
order to get to a person in-
side, Brandon Joseph Grif-
fin, 27, was served a warrant
charging PV (harassment).
And he was cited to appear.
*Joshua Jason Bowers,
31, was arrested on a charge
of ROV and lodged in
county jail.
Monday, Jan. 16
*In the 7000 block of
Caves Hwy. a man said that
another person continues to
divert water from Sucker
Creek onto his property,
causing damage. The com-
plainant said he would again
contact Oregon State Police.
*At the site of a Dec. 13
structure fire on Caves Ave-
nue, a man in a red-flannel
shirt was said to be hanging
around, apparently trying to
gain access to what remains
of the residence.
*Taken sometime the
night before, a blue-and-
white Ford pickup truck
with 1/4 tank of fuel was
reported stolen at 9 a.m.
*Contacted while
parked at a church on Caves
Hwy. a man eating lunch
was ascertained to be caus-
ing no problem.
*Phoning
from
McMullen Creek Road, a
young man said that he had
stashed a motorcycle in
bushes near Lake Selmac
after someone yelled at him
for riding it. When he re-
turned for the bike, he said,
it was gone. However, when
asked to whom the motorcy-
cle belonged, he said,
“Never mind, I don’t want
to make a report.”
*When he left a resi-
dence on White School-
house Road where he had
lived and worked for three
years, a man took a minia-
ture bull that he understood
had been given him as par-
tial payment. The woman
complaining that her bull
had been stolen did not be-
lieve this to be the case.
Both parties were advised to
seek legal options through
the civil process.
*Continuing problems
with tenants on Taurus Lane
culminated in reported theft
of items including a digital
camera, electric drill, and
police scanner a man said.
*Attempting to phone a
relative in Nevada, she said,
a woman on Norman Road
accidentally dialed 911 at
10:43 p.m.
Tuesday, Jan. 17
*Completely blocking
Reeves Creek Road at 12:11
a.m., a “really, really big
tree” presented a big prob-
lem. County public works
was notified and was on
scene by 2:15 a.m. to clear
the way.
*Phoning from Califor-
nia, a mother was concerned
about the welfare of her 35-
year-old daughter and her
three children, who, when
last heard from, said they
were staying in O’Brien,
were cold, lacked money
and were having problems.
The information was noted
for patrol.
*Ryan James Dutton,
32, was served a warrant
charging parole violation
and failure to comply on an
original charge of menacing
after turning himself in to a
deputy at the Illinois Valley
Substation.
*Telephone service
workers on Naue Way ap-
parently caused a 911 hang-
up call at 11 a.m.
*Kati Marie Johnston,
19, was served a Coos
County warrant charging
first-degree theft and lodged
in Josephine County Jail.
*A woman in the proc-
ess of evicting her ex-
boyfriend was cornered by
him after he broke into her
home on S. Kerby Avenue,
a neighbor reported. The
woman was advised of her
options, and was to seek a
restraining order.
*Approximately $225
damage was reported at a
home under construction on
E. River Street where wiring
was cut and removed.
*A stolen vehicle was
recovered in the 400 block
of N. Sawyer Avenue.
*On Holland Loop a
soon-to-be evicted tenant
complained that her landlord
had removed a circuit
breaker, cutting power to the
residence. The property
owner was apparently un-
aware that this was illegal.
*Animal Control was
notified of a dog left in a
broken-down and aban-
doned vehicle parked two
days at Caves Christian Fel-
lowship in the 24000 block
of Redwood Hwy.
*Accidentally shifted
into gear, a driverless vehi-
cle with three passengers
struck the Sportsman Tav-
ern at 5:45 p.m.
*Overheard fighting
about possession of a hand-
gun in the Taco Bell drive-
through, the three teen-aged
occupants of a red Toyota 4-
Runner were last seen
headed south on Redwood
Hwy. toward the California
border, a restaurant em-
ployee said at 6:30 p.m.
Saturday, Jan. 14
*A “carload of juve-
niles” had been in front of
his residence consuming
alcohol, said a man on
Draper Valley Road just
after 1 a.m., and then they
left, driving unsafely.
*After a “very irate and
violent” Geoffrey Allen
Norris, 27, contacted by
phone a woman he wasn’t
supposed to, he was arrested
on a charge of violating a
restraining order (ROV) and
lodged in Josephine County
Jail. Also, Erica Lee Eldred,
22, was cited on a charge of
interfering with police.
*Detained in the 4000
block of Happy Camp Road,
Damon Lee Hubbs, 19, was
cited for lack of an opera-
tor’s permit; and Warren
Lee Hubbs, 41, was cited on
a charge of failure to tag a
load of firewood.
*On Laurel Road a man
said he suspected another
person with whom he had
fought at a bar overnight to
have rammed his front gate
with a vehicle, damaging it.
Sunday, Jan. 15
*Following an alcohol-
fueled domestic altercation
in the 28000 block of Red-
wood Hwy. at 1:23 a.m., a
woman said that she did not
need an medical attention.
Charges of fourth-degree
assault, three counts of
fourth-degree domestic as-
sault, interfering with a 911
call, probation violation and
driving while suspended
(DWS) were reported.
*While in Community
Oriented Policing (COP)
mode, a deputy contacted a
group of young people in
Downtown Cave Junction at
2:30 a.m. They were ad-
vised of the curfew, and told
to get to their destination
“and stay there.”
*Target shooters at a
gravel pit on Upper Deer
Creek Road may or may not
have been using their fire-
arms safely, but a resident
nearby wanted a deputy to
find out.
*An address sign mark-
ing a property on Lakeshore
Drive was removed, a man
reported.
