TRUSTEE’S NOTICE OF SALE
The obligations secured by the Trust Deed de-
scribed in this notice are in default and the
beneficiary has elected to foreclose the Trust
Deed pursuant to ORS 86.705 through ORS
86.795. No action is currently pending to re-
cover any part of the debt secured by the Trust
Deed.
The following information is given pursuant to
ORS 86.735 and ORS 86.745:
1. TRUST DEED: The Trust Deed was exe-
cuted by Bill Leahy and Berna G. Leahy, hus-
band and wife as tenants by the entirety, as
Grantor; to First American Title Insurance Com-
pany of Oregon as Trustee; for the benefit of
Donald Lorensen, as Trustee for The Donald
Lorensen Revocable Living Trust under the
agreement dated February 28, 1994, as to an
undivided 1/2 interest, and Karen J. Lorensen,
as Trustee for The Karen J. Lorensen Revoca-
ble Living Trust under agreement dated Febru-
ary 28, 1994, as to an undivided 1/2 interest, as
Beneficiary. The Trust Deed is dated April 26,
2002 and was recorded May 2, 2002 as Docu-
ment No. 2002-009337, Official Records of Jo-
sephine County, Oregon.
2. PROPERTY: The property encumbered by
the Trust Deed is situated in Josephine County,
Oregon and is commonly known as 2301 Laurel
Road, Cave Junction, Oregon, and particularly
described as follows:
PARCEL 2 of PARTITION PLAT NO. 2001-013,
located in the Southeast Quarter of Section 22,
Township 39 South, Range 8 West of the Wil-
lamette Meridian, Josephine County, Oregon.
3. DEFAULTS: This foreclosure is a result of
the following defaults:
Failure to pay monthly installment payments of
$1,550.60 each, falling due on 1st day of April,
2003 and on the 1st day of each month thereaf-
ter.
4. BALANCE OWING: The following sums are
owing on the obligation secured by the Trust
Deed: The entire unpaid principal balance of
$197,234.44 with interest thereon at the rate of
7% per annum from March 23, 2003 until paid.
5. ELECTION TO SELL: As a result of the de-
faults set out above, the beneficiary and the
trustee have elected to sell the property to sat-
isfy the obligations secured by the Trust Deed.
A Notice of Default has been recorded pursuant
to ORS 86.735(3) and the beneficiary has de-
clared all sums owing on the obligations se-
cured by the Trust Deed immediately due and
payable.
6. SALE: The property will be sold in the man-
ner prescribed by law on November, 19, 2003
at 2:00 p.m. in accord with the standard of time
established by ORS 187.110, at 200 West
Lister Street, Cave Junction, Josephine County,
Oregon, which is the office of Mansfield R.
Cleary.
7. RIGHT TO CURE DEFAULT UNDER ORS
86.753: Any person named in ORS 86.753 has
the right, at any time prior to five days before
the date last set for the sale, to have this fore-
closure proceeding dismissed and the Trust
Deed reinstated by payment to the beneficiary
of the entire amount then due (other than the
portion of the principal that would not be due
had no default occurred) together with costs
and expenses actually incurred in enforcing the
obligations, including trustee’s and attorney’s
fees and any sums advanced by the beneficiary
pursuant to the Trust Deed and by curing any
other default complained of herein that is capa-
ble of being cured by tendering the perform-
ance required under the note and Trust Deed.
THIS COMMUNICATION IS FROM A DEBT
COLLECTOR. This is an attempt to collect a
debt and any information obtained will be used
for that purpose.
