Hearings and Appeals Process Can Follow Denial of License by STGC By Shawna Gray, STGC Executive Director In the last article we explained what the Siletz Tribal Gaming Commission (STGC) looks at when making the decision to deny a gaming license. We also briefly mentioned the hearing/ waiver process. If STGC takes gaming license action, the applicant will receive a Notice of Ap peal form that is included in the licensing action decision. The applicant can request a hearing by completing the Notice of Appeal form and returning it to the Office of Hearings and Appeals within 15 days of receiving the licensing action notice. The applicant also can request that his or her hearing be expedited for a faster turnaround time. The Office of Hearings and Appeals consists of two hearings officers hired by the Tribal Council to serve three-year staggered terms. The Office of Hearings and Appeals is located in the same build ing as STGC. The hearings officers appoint a chair man among themselves to serve for one year. The current hearings officers are Chairman Patricia Myers and Officer Ronald Chatham. Both of these positions serve on an on-call basis. STGC also is represented at the hearing, which is conducted like a court trial but is less formal. The proceedings are recorded; the applicant can submit evidence, have witnesses and have an attorney or spokesperson present. The Office of Hearings can subpoena an individual if warranted. In the Notice of Appeal, the applicant must make noti fication to the hearings officers regarding having an attorney or spokesperson. Once the hearings officers receive an appeal, they meet to review it to determine if the appeal has merit and decide if the applicant should be granted a hearing. If the decision is to grant a hearing, the hearings officers notify the applicant via mail by sending a Notice of Hearing, which gives the applicant the date, time and location of the hearing. If a hearing is not granted by the hearings officers, the applicant is sent a Denial of Hearing via mail. After the hearing, the hearings of ficers review the evidence and testimony provided by the applicant and STGC to determine the outcome. Once the outcome has been determined, the hearings officers will notify the applicant and STGC in writing of their final decision. If the applicant was not successful in the hearing, he or she then can appeal to Tribal Court. The Tribal Court then will review the case and make a determination on whether the hearings officers followed appropriate process with the case. Set Goals for Eight-Week Women’s Exercise Challenge We will participate in the Women's Exercise Challenge this year. This is an eight-week challenge aimed at meeting exercise and weight-loss goals. We invite all Tribal employees and community members from the Siletz-Logsden area to join our team. We will hold an open house at the Tillicum Fitness Center on May 10 from 10 a.m. to 1 p.m. and 4 p.m. to 6 p.m. During this time, we will help you get an online account to join the Siletz Women’s Exercise Challenge team. Every week that you meet your per sonal goals, you receive a virtual trophy and after eight weeks, you will receive a certificate of completion. You also will receive weekly e-mails with tips on stay ing motivated and quizzes on health and nutrition that give you bonus points toward your complete exercise challenge. Siletz Women’s Team members can send encouraging messages to each other as part of the online team. During the first hour, we will have diabetes and cholesterol screening available for those who are interested. For best results, it’s recommended that you fast for 10-12 hours prior to your test. At the open house, we will form the Siletz Women’s Team, get participants set up with their account, address personal exercise and goals and provide informa tion on diet strategies. We will have a personal trainer to help with exercise goals, weigh-ins and measurements for anyone interested. We will meet weekly through May and as interest dictates to help you update your online profile and goals reached, weigh in, exchange healthy recipes and have healthy cooking demonstrations and lunch. If you have not joined the fitness cen ter, this will be an excellent opportunity to get oriented to it, the exercise equipment and classes offered. If you are not able to attend the open house, you can register online at www. womenshealth.gov/woman. There is an option of joining a team and you can select “Siletz Women.” Even though you are not present, you still will be part of the team and can send and receive messages to other team members. You will be able to set your own weekly goals and track your progress.
