There shall be full and complete discussion of all the aspects of the charges of neglect of duty or gross misconduct prior to Tribal Council action. §2.63 DECISION AND EFFECTIVE DATE Any Tribal Council decision to expel shall be by a vote of at least two-thirds of the total membership of the Tribal Council and shall be effective immediately PART V APPEALS §2.64 APPEALS Any final decision of the Election Director, Election Board or the Tribal Council under this ordinance may be appealed to the Tribal Court under the rules of appellate procedure, provided that such actions shall be heard and ruled on by a law-trained judge who is not a member of the Siletz Tribe. CERTIFICATION The foregoing ordinance was amended by the Siletz Tribal Council at a Regular Council meeting held on August 17, 1996 at which a quorum was present, and the ordinance was amended by a vote of 5 FOR, 3 AGAINST, and J _ ABSTAINING. Language which is recommended for inclusion into the draft is represented by underlining and that recommended for exclusion is stricken. The first set of comments are those recommended by the Tribal Council and the second set are those recommended by the Ad Hoc Constitution Committee if any. Bensell, Eloise Case, Delores Pigsley, Pauline Ricks, Stanley Strong and Bob Tom AMENDMENTS RECOMMENDED BY TRIBAL COUNCIL SUBCOMMITTEE Approved Tune 2, 1979, by the Confederated Tribes of Siletz Indians of Oregon Approved Tune 13,1979, by the Secretary of the Interior of the United States of America CONSTITUTION OF THE CONFEDERATED TRIBES OF SILETZ INDIANS OF OREGON PURPOSES We, the members of the Confederated Tribes of Siletz Indians of Oregon, being a federally-recognized Indian tribe and organized pursuant to the Act of November 18,1977,91 Stat. 1415, and the Act of June 18,1934,48 Stat. 984, hereby adopt this Constitution and establish our tribal government in order to: (1) Continue forever, with the help of God, our unique identity as Indians and as the Confederated Tribes of Siletz Indians of Oregon, and to protect that identity from forces that threaten to diminish it; (2) Protect our inherent rights as Indians and as a sovereign Indian tribe; (3) Promote our cultural and religious beliefs and to pass them on in our own way to our children, grandchildren and grandchildren's children forever; (4) Help our members achieve their highest potentials in education, physical and mental health and economic development; (5) Maintain good relationships with other Indian tribes, the United States, the State of Oregon and local governments; (6) Support the Government of the United States and encourage our members to be loyal citizens; ARTICLE I - MEMBERSHIP SECTION 1. REQUIREMENTS. The membership of the Confederated Tribes of Siletz Indians of Oregon shall consist of all persons who are not enrolled as members of another federally recognized tribe and (A) Whose names validly appear on the official tribal roll dated May 16, 1978, provided that, if noeoooary and oub j ect to the approval of the S ecretary of tho Interio3_ the blood quantum levels listed thereon shall be corrected by the governing body of the Confederated Tribes of Siletz Indians of Oregon; or (B) Who possess one eighth one-sixteenth or more degree Siletz blood quantum, have filed an application for enrollment with the appropriate tribal body and have been accepted as members in accordance with the tribal ordinance adopted under Article I, Section 2 of the Constitution. For purposes of this section, "Siletz blood" is defined as all Siletz Indian blood derived from a direct ancestor who was is named on any roll or records of the Siletz Tribal enrollment Department members prepared by the Department of the Interior prior, to the effective date of this Constitution. Sec. 2. Ordinance The Tribal Council shall enact an ordinance establishing procedures for processing membership patterns including application procedures and blood degree corrections of the May 16,1978, roll as provided in Article I, Section 1, of this Constitution within six months of the Tribal Council's election to office under this Constitution. The ordinance shall contain procedures, including the right to appeal. Sec. 3. Adoption Sec. 3. Honorary Roster The Tribal Council shall establish an Honorary Roster.
