When Bundy and the
others didn’t appear at the
6 p.m. meeting, Palmer
continued without them.
Those attending at the
time were unaware that at
approximately 4:25 p.m.
the Federal Bureau of
Investigation (FBI) and
Oregon State Police (OSP)
“began an enforcement
action to bring into custody
a number of individuals
associated with the armed
occupation of the Malheur
National Wildlife Ref-
uge,” according to a press
release.
It’s undisputed that
during the arrest, there
were shots fi red by law
enforcement, killing
Finicum. Initial reports are
that no shots were fi red by
Finicum or others in his
vehicle. Other details are
pending.
The incident took place
on a heavily wooded
stretch of Highway 395
with deep snowbanks on
either side.
Ryan Bundy, who was
also riding in Finicum’s
truck, suffered non-life
threatening injuries due to
a single gunshot or shrap-
nel wound to the upper
arm, and was transported
to the hospital for treat-
ment. He was arrested and
is currently in custody.
The arrested individuals
include:
• Ammon Edward
Bundy, age 40, of Emmett,
Idaho;
• Ryan C. Bundy, age 43,
of Bunkerville, Nevada;
• Brian Cavalier, age 44,
of Bunkerville, Nevada;
• Shawna Cox, age 59,
Kanab, Utah;
• Ryan Waylen Payne,
32, of Anaconda, Montana.
In a separate event in
Burns, Oregon, at approxi-
mately 5:50 p.m., Oregon
State Police arrested:
• Joseph Donald
O’Shaughnessy, age 45,
Cottonwood, Arizona.
All were booked in the
Multnomah County Jail
Wednesday morning, all
pleading not guilty.
All of the named defen-
dants face a federal felony
charge of conspiracy to im-
pede offi cers of the United

States from discharging
their offi cial duties through
the use of force, intimida-
tion, or threats, in violation
of Title 18, United States
Code, Section 372.
Journalist Pete Santilli
of Ohio, who had been
embedded with the occupi-
ers on the Refuge since
January 2, was arrested on
the same felony charges.
Multiple other individu-
als, said to include journal-
ists as well as others who
were visiting the Refuge,
but not part of the original
occupation, were held for
approximately two hours
and then released.
Throughout Tuesday
night and into Wednesday
morning, the FBI sur-
rounded the Refuge, set-
ting up a series of check-
points on roadways.

and Oregon State Police
have initiated a contain-
ment of the Malheur
National Wildlife Refuge
in order to better ensure
the safety of community
members and law enforce-
ment. This decision was
made out of an abundance
of caution... The contain-
ment procedure involves
a series of checkpoints es-
tablished along key routes
into and out of the Malheur
National Wildlife Refuge.
“Attempts to Travel Into
the Refuge
“There will be signage
ahead of each checkpoint.
Anyone who moves
beyond that signage will
be stopped, identifi ed and
asked leave. Non-compli-
ant people will be subject
to arrest.
“Leaving the Refuge
Anyone coming out of the
refuge will have his or her
identifi cation confi rmed
and any associated vehicles
searched.
“Resident Ranchers
Only
“The only people al-
lowed to pass into the
checkpoints will be Harney
County ranchers who own
property in those specifi c
areas. They will be re-
quired to show photo ID as
they go in and out.”
Addition arrests were
made Wednesday: Duane
Leo Ehmer, age 45, of Ir-
rigon, Oregon, and Dylan
Wade Anderson, age 34, of
Provo, Utah, and Jason S.
Patrick, age 43, of Bo-
naire, Georgia. All were in
contact with the FBI, and
each chose to turn himself
into agents at a check-
point outside the Malheur
National Wildlife Refuge.
The arrests were without
incident.
