federal appeals court has overturned a
lower court ruling saying a waiter who
was taunted for walking “like a woman” can
sue the restaurant under federal laws pro
hibiting sex discrimination.

Antonio Sanchez worked at a

8 Enterprises, where he says he was sub-
w jected to daily verbal abuse by
| employees and a supervisor. He said
he told several managers and the
1 human resources director about his
problem but did not get a significant
response. He was fired a few months
later for walking off the job in the
middle of his shift.
Sanchez filed suit in district court,
which ruled against him, saying he
had not been subjected to a hostile
environment based on his sex. The
9th Circuit Court of Appeals over
turned that ruling, saying the “unre
lenting barrage of verbal abuse” was
severe and pervasive.
The appeals court decision was a
departure from other rulings that
have made it difficult for gay men
and lesbians to obtain protections
under Title VII of the Civil Rights
Act because the law does not cover
sexual orientation. However, San
chez’s case never suggested the plain
tiff was perceived to be gay.
Rather, he was subject to harass
