In a 2-1 ruling, the Court of Appeal said family law must be applied equally to same- and opposite-sex couples. The justices based their decision on the federal Charter of Rights and Freedoms. The case involved a lesbian relationship that ended after 10 years. GERMANY A Romanian man made German history in November when Munster’s High Administrative Court ruled he can stay in the country with his German male lover, reported Rosa Zene. The court also set down requirements for future such cases, including: the foreigner must have sufficient space in his lover’s abode, he must be supported financially by the German for “a consid­ erable period of time,” and he must have adequate health insurance when he first enters Germany. ISRAEL Israeli President Ezer Weizman denounced and made fun of gay men during an address to high-school students in Haifa on Dec. 20. “[Homosexuality] is abnormal from a social point of view,” Weizman said. “I personally do not accept this business of everyone coming out of the closet,” he continued. “It seems to me to be weird.... 1 hope you are not in favor of sodomy.... SPAIN The Socialist Party has introduced partnership legislation that grants pension, inheritance and other spousal rights to same-sex couples. Adoption rights were withheld from the pro­ posal. The governing Popular Party—which has a conservative, Christian bent—said in December it supports the measure. Some sexual minority activist groups have refused to endorse the bill because of the adoption exclusion. SWITZERLAND The Swiss government’s proposed new con­ stitution does not ban discrimination based on sexual orientation. The document, which incorporates results of a public-opinion poll, overlooks sexual minorities, even though two dozen organizations and 400 citizens told pollsters the anti-bias clause should protect homosexuals. The groups Pink Cross and Lesbian Organiza­ tion of Switzerland said they are “indignant” and plan to fight the exclusion. The constitution will be debated in parliament this year and adopted in 1998.
