Brown, former speaker of the California Assem bly, faces incumbent Mayor Frank Jordan in a runoff election Dec. 5. A former San Francisco supervisor, Achtenberg became the highest ranking lesbian in the Clinton admin istration when she was appointed an as sistant secretary at the Department of Housing and Urban Development. Her Senate confirmation hearings for the HUD post inspired noted homophobe Sen. Jesse Helms (R-N.C.) to label Achtenberg a “gar den variety lesbian,” _ . . , as he fought to block Roberta Achtenberg her appointment. She resigned her HUD position to enter the San Francisco mayor’s race. 1 800 871-9440 - Fc national news • 5 0 3 -2 2 1 GEORGIA Two Atlanta apartment dwellers face eviction because they refused to remove a rainbow flag from their patio. Joe M esservy and Julie Piwaren received a no tice from the manager of the Druid Walk Apart ments telling them to take down the flag be cause their lease requires “clean and organized” porches and balconies. Southern Voice reports. They did not comply and received an eviction no tice dated Oct. 2. Messervy and Piwaren believe they have been singled out by the apartment manager. “I’ve seen people hanging their underwear up on the porch. I’ve seen over six people living in several apartments, and I’ve seen what appears to me as drug dealings out of some of these apart ments, yet they want to evict us over a flag,” Piwaren said to the Southern Voice. . The two tenants are fighting the eviction no tice. They have contacted a lawyer and are plan ning a demonstration with ACT UP. ILLINOIS On the legal front. Lambda Legal Defense and Education Fund filed an appeal with the federal Court of Appeals for the 7th Circuit in Chicago, seeking toovertum a ruling by a Wisconsin federal judge dismissing a lawsuit by a gay student against his former school. Jamie Nabozny was subjected to brutal verbal and physical harassment at the hands of his class mates. The assaults began when Nabozny was in the seventh grade and continued through the 11 th grade in his Ashland, Wise., school district. Class mates trapped him in hallways and bathrooms and beat him, punched him, kicked him and urinated on him. During one attack, while other students watched, several boys pinned Nabozny to the floor and acted out sexual acts on him. Nabozny was subjected to constant and relentless verbal abuse. As a result, he attempted suicide, dropped out of school, and was diagnosed with post traumatic stress disorder. Nabozny’s parents supported their gay son and tried desperately, and unsuccessfully, to get school officials to discipline the boys who tormented him. Telling Nabozny that “boys will be boys,” school officials refused to take any meaningful action to end the attacks. Lambda seeks to overturn the district court ruling that denied Nabozny the opportunity to take his case to court. ▼ ▼ ▼ Overlooked Opinions, a Chicago-based gay market research firm, last month launched GayCensus ’96, the single largest assessment of the lesbian and gay population in the United States and Canada in history. INDIANA An Indiana bartender who was fired when his employer learned he was HIV positive reached a settlement in his suit against his former employer, a restaurant called The Pub. Larry Conway, the former bartender, and The Pub agreed to the terms of a consent decree that settled a suit brought against the restaurant by the Equal Employment Opportunity Commission, the federal agency charged with enforcing the Americans with Disabili ties Act. The Pub must pay Conway an undis closed monetary sum, begin HIV transmission and sensitivity training for all employees and adopt a policy that en sures confidentiality for all employee medical in formation. Compliance will be monitored by the EEOC. NEW YORK A Brooklyn family court awarded guardian ship of a 3-year-old child to Sofia D„ the lesbian partner of the child’s biological mother. The bio logical mother died less than a month after giving birth to the child. Several parties competed for guardianship, including the biological mother’s estranged husband, the putative biological father, the estranged husband’s mother and the child’s maternal grandmother. In the ruling, the judge found that Sofia D.’s sexual orientation “is not determinative of her fitness to be [the child’s] guardian.” The court also found, in determining the child’s best interest, that “[t]he only person here who has always been a stable, loving presence in [the child’s] life from the time he was bom is Sofia D.” Compiled by Kristine Chatwood
