Because some unforseen difficulties have arisen is no
reason why the council should “lay down” in the matter
of constructing waterworks. Almost every municipality
has encountered obstacles in the path of progress, the
overcoming of which butserved to make the value of the
improvements more apparent. The aim of the council
to secure a water supply for the city is a laudable one,
and althongh mistakes may have been made there is no
good reason why the proposition should be abandoned;
the difficulties and set-backs that have been encountered
should rather serve as a spur to further and more careful
work in the future. The majority of the citizens have
shown by their votes at the bond elections that they want
water and we believe will insist that the matter be carried
forward to a successful issue. Stick to it, the people are
backing the proposition.
Work on the water system is at a standstill and it
seems likely to continue so for the present at least.
Efforts are being made to effect a settlement with Mr.
Mears, the contractor whereby the city will take over the
uncompleted work, material, etc. and relieve him from
further duties in the matter. An estimate of all work
done and material furnished, has been made by the en
gineer and a proposal submitted which if accepted will
sever his connection with the work.

ruary. 1911 filed with the City Record

the instructions of the City Engineer,
T. W. Osgood, relative to the perfor
mance and execution of said work in
complaince with the terms of the a-

Whereas, said Contractor by his
conduct and acts has so failed to com
ply with the instruction- of said City
Engineer; and,
Whereas, said r .fusal is a direct and
positive violation of the terms of said
contract causing great damage to the
City of Jaoksonville and which damage
will be greatly augmented with each
additional days work in violation of the
instructions of said City Engineer and
in violation of said contract:
NOW, THEREFORE, the said Con
tractor, James .1. Mears, is hereby
ordered and
required to
stop
and desist from the further proseeu-
tion of work and labor and the furnish
ing of material under the terms of
the aforesaid contract or otherwise un
til the further writfen order of the
City Council.

complaint of James J. Mears be inves
tigated by the City Council and the
City Engineer is hereby required to
file a report setting forth specifically
the failure or failures of said Contrac
tor to comply with the instructions of
said Engineer and the terms of said
contract and that thereupon the City
Council take final action in the prem
ises.

quirement of this Resolution by per
sonal services upon him by the City
Marshal of an Order and Notice in the
following form, to-wit;
To James J. Mears:
You will please take notice that
your written refusal to comply with
the instructions of the City engi
neer, T. W. Osgood, in reference to
the performance and execution of that
certain contract of yourself with the
City of Jacksonville of date of Novem
ber, 26th. A. D. 1910 for the construc
tion of a water works, which refusal
you filed with the City Recorder or the
13th. day of February, 1911, and
which you have since orally reiterated
and carriedlinto effect by your conduct
and acts, is a direct and positive vio
lation of *he terms of your contract
aforesaid and you are hereby re
quired
and
ordered
to desist
and stop all further prosecution and
performance of work and labor and
the furnishing of material in accord
ance with the terms of Haid contract
or at all until the further written order
of the City Council so to do.
And you are hereby further notified
that the City of Jacksonville will not
pay for or be resposible for or accept
any work, 'aboror material expended or
used under the terms of said contract
or otherwise after the date hereof un
til the further written order of the
City Council.
And you are likewise further noti
fied that you and your surety, PAC
IFIC SURETY COMPANY, a Corpor
ation, organized and existing under the
laws of the State of California, will be
held to a strict performance of said
contract and for any damages resulting
to the City of Jacksonville from the
violation thereof.
This notice and order is served
upon you by order of the City
Council of the City of Jacksonville,
pursuant to a Resolution duly and reg
ularly adopted at a regular meeting
thereof held at the City Hall on the
14th. day of February, A. D. 1911
