Supreme Court Holds That St. John
Charter, Is Superior to Local
Option Law.
Through nu opinion written by As
sociate Justice Will K. King, the su
preme court has announced an opin
ion in which it is held that the char
ter o the city of St. Johns is similar
to that of the city of Medford in that
it is superior to the local option law.
The St. Johns charier is held to be a
KiMwiul act authorized by an amend
ment adopted by the. initiative in 1900
by which the power is conlerred upon
J the city council of St. Johns to regu
late the sale of liquor.
The act was tested by an aetion
brought against Sam Cochran by the
prosecuting attorney for Multnomah
3 eonnty for a violation of the local op
tion law. Cochran, upon paying a fee
of $12(10, was granted a license to s.ell
liquor in St. Johns. The city couucil
granted the license after receiving the
advice of the city attorney to the ef
fect that the local option law did not
apply in St. Johns. Cochran was con
victed in the circuit court, but the
conviction is reversed by today's de-
cision and St. Johns is declared a
"wet" burg.
What distinction is pointed out be
tween the charters of the city of Med
ford and the city of St. Johns by the
district attorney are held by Justice
King to be inconsequential. For in
stance, it is held the word "regulate"
includes "to license."
GOLD HILL ITEMS.

D. E. Neidhamer, one of Evans
' Creek's prosperous ranchers, was a
southbound passenger through Gold
Hill Tuesday.
Recorder Harvey became mixed up
with a yellow jacket while working
in the bush at the Ray dam and in
consequence he was obliged to ap
pear at the council Monday evening
with his left eye about closed up.
Sam McClendon returned from his
ranch in the Sams Valley country
the f irst of the week. , Mr. McClen
1 don has rented the ranch to Messrs.
Jones and Treshnm of that locality.
It contains 640 acres.''
Ashland Enrollment.
The total enrollment in the Ash
land public schools to date amounts
to 9G(i. The enrollment in the high
school 'department is 171.
This is a large increase over the
total enrollment for the correspond
ing period last year, but high water
mark in this year's enrollment will
not be reached for some time yet and
the one thousand mark is in sight.

19, 1909, for a license to sell spirit
ous, vinous and malt liquors in quan
tities less than a gallon, for the pe

street, North, in faid city.

TORY AND BUSINESS
SCHOOL NOTES.

Two good places are yet open for
girls who wish to attend to light work
for board. .
A teachers' review class will be
formed next week. There is oportu
nity to review English and American
literature, bookkeeping, physical ge
ography, algebra, etc., and all of the
common branches.
The seven rooms of the school
building are now in use.
The school has enrolled to date
52 students and will easily exceed
100 enrollment for the year.
The class in freehand drawing is
doing good work under Miss Hall. As
soon as the text books arrive the me
chanical drawing will begin.
The third student from Coos coun
ty will enter in November.

are on the tables for the use of the:
students. I
The commendable feature of our
bnsiness course is the practical wayi
in which it is taught.
At the students' reception Friday,'
evening of this week at the school
building there will be a short pro-
ram, amusements and a general so
cial time.
The football team under the man
agement of Ed Vincent is getting in
some good practice. The team will
meet on the gridiron the Medford high
school team on Saturday, October 23,
at Medford.
Callers of the week were Superin
tendent J: P. Wells of Jacksonville,
DeWitt Chaney and Oscar Stephens
of Myrtle Creek.
All young people, pnrticaularly
boys, who have not had good opor-
tunity for education and feel that
they are behind in school branches,
these are especially invited to try
our .school.

The Orr Lake Lumber company will
run its mill on Autelow creek as long
as possible, which will be when deep
snows come.
The Park mill, which has been idle
for two years, will start up -non and
the Tuckwcll mill which has been un
der attachment for two years, has
been purchased by Davis & Field,
who exH'rt to begin running at once.
They have contracted to m'II nil of
the liumher right off the miw.
The local demand for lumber is
quite brisk, ns there is n great deal
of building in progress throughout the
vallev. '
