The Portland Telegram mi.: In granting it perpetual injunc tion against the appropriation by the state for the Crater Luke roud, Judge Galloway has stirred up tho animals in the sou'hora part of the state. The bill carrying the appro priation was only unused after hard campaign in the recent legis lature, mid the men who boosted for (ho scenic road do not intend lying, down becauso of tho court's decision. The mutter will he appealed to the Supreme Court, where, the constitu tionality of the act is to be tested. When it comes to the Supreme Court the friends of the mud feel confident Ibiit they will win, for a palpable reason. The legislature which passed the Crater I.uko Itoad bill, which is held unconstitutional, also increased Ihe number of members of the Su premo Court bench, when the con stitution says tin re shall be three Supremo Justices. Tho road pooplo contend .thai, if one act was i;i ou slitutioual then the other was, anil that if tho legislature had no right to make Ihe appropriation for tha mad, then it hud no right to iuerenso the number of justices. The Su prcmc Court may entertain a similar idea. The contention of Judge Galloway is that the appropriation for tho Cra ter Lake road would benefit but two counties. The argument of tho road advocates at Salem whs that tlta two counties interested were willing to lax themselves heavily towards the project, nnd that the t'nited States government would invest thousands of dollars tliore than the statn of Oregon , nnd that Iliirrimiin himself would chip in $50,000. Tho argu ment was that tho Crater Luke roud is not it local enterprise, but a state wide proposition, for the lato nt lurgce would benefit through tho ad vertising the scenic wonders would receive, ami thousands of tourists would visit Oregon who uvuld not otherwise come here. I, urge delega tions from .Medford and Ashland lob bied nt the legislature through the session, being reinforced by Portland people ,and they put up siu-h a strong light that the' appropriation eventu ally carried. Pending the stale assistance, the people in the Crater lake territory have been building the road uiu! mak ing it fit for automobiles. Tho lake can now be reached by molor cars, but with the levies from Iho couiitic the stale and Ihe federal government the mini was to be nuiiln wide, solid nnd enduring. The decision of Judge Galloway will bo fought persistently. HO W O REMEMBER THE IMPORTANCE OF ALWAYS GETTING THE BEST IS TO BR CARELESS IN YOUR OR DERING, THEN PAYTHE PENALTY.'
