MJSDFORD, OREGON, SATURDAY, JUNE 12, 1909. 5 ON THE GRATER LAKE ROAD SUIT The construction of the city wator pipe line will reach the ilnnley ranch Monday or Tuesday and, pending the u',ion now in the circuit court of Jackson county, the construction crew, numbering 150 men and a large number of teams, will be held up and unless a speedy determinatiou of the matter can be had in the court the crew may be disbanded. An action at law has beeu com menced by the city toondemu a right of way through the Hanley property and the case has been set down for hearing Tuesday before Judge flanna. Unfortunately the laws of eminent domain of the state have made no provision for the immediate taking of property except by an action At law nud subject to the verdict of a jury. The .city attorney, by an amendment to the charter, .has culurged the pro cedure so 'that the city, by deposit ing a sufficient amount for the land sought to be condemned, may take immediate possession, and if the cir cuit judge holds this enlargement of the power of eminent domain to be regular, then delay will be expe rienced. If, however, the judge should hold a corjrnry view and the su preme court should sustnin his con tention, a most serious delay to the city would result, and the injury to the city as a consequence would be incalculable. With several miles of wooden pipe drying out pending the result of a long fought action in the courts, the prospect of which is not so remote as might bp supposed, the notion now pending is one of the greatest concern to the people. Ed Hanley is n man who has at all limps been nmennble to reason, and there is littlp douht that if hp -were satisfied that his action against the cily would in no trimmer be preju diced by suffering their work to con tinnV, he would yield .to tho public :'t'd ifn permit the work to go on. ' 1 James K. Pattou to John F. The suit to tie up the Crater Lake road appropriation, which is now on in the Marion county court, will be . tried out on uoxt Wednesday at 1 ' p. m. The attorneys in the case are , hard at work and will be thoroughly prepared when the matter comes up. Tho attorneys, upon consultation, thought best to take some evidence so that the mailer might be presented to the upper court in tho most favor able light. For that reason they filed n demurrer to the amended com plaint of the plaintiff which the court overruled; they then filed an answer, to which the plaintiff filed a demur-: rer, and when the demurrer was over ruled a reply was filed. In the reply Atlornoy McMnhon de- ; nied that the road was to be con st runted from tho Idnho line to the Pnnifio ocean, that the road would , be of benefit to the state at large, that it was not the most direct and logical oourse for such a road. The! attorneys for the defendant have ; agreed with tho attorney for the plaintiff that they may produce such witnesses an they desjre in evidence regarding the route of the road and ' as to its benefits. The evidence will be taken next Wednesday and the evidence made up then.
