The trial nf William Hauley, one ol' (ho biggest Htoekmeti of eastern Ore;iia( anil wull known in this city, on a charge of illegally maintaining an eneloKure of government land started today in the federal court in Portland. Hanley, uh manager of the Hamey Valley Development eompany, is ae eusod of maintaining fences that ef feetiuilly inclose approximately 80, 000 acres of the government domain. This land is situated in Marncy coun ty and is so situated that it need only he partly inclosed to prevent access to the grn.ing lands it contains. On the west there is a rim rock harrier as effective as a fence. On the south and cast connecting links hclween canyons hae heeu seripped in 40 ncre strips. On the east one strip of deed land 40 acres wide is 12 or l.'l miles long. The fences are all on deeded laud, hut the effect, it is con tended hy the government, is the same as if the government laud itself were fenced. The scheme, it is said, was eon ceived hy I'cto French, who was kill ed a numher of years ago in an at tempt to eject a homesteader from the inchtstire. For the defense, it is said, it will he contended that llnuley became interested in the management of the llurney Valley Development company nflcr the fences had heeu construct ed and that it was the intention of the company under his management to remove them. The government will attempt to pro duce testimony showing that under Mauley's management the offending fences have heeu repaired and that there has been on apparent intention of removing them. The land fenced is dedsenbed as suitable only for graz ing purposes.
