Whereas, There were duly submit ted to the voters of the city of Med ford, Oregon, ut a special election duly he-Id on May 10, l'J09, suid elec tion having been duly culled and due notice thereof having been given, the following amendments to the char ter of the city of Medford: I A churter amendment of the churter of the city of Medford, Ore gon, umcndiug section twenty-five (2) of .said charter. II A churter amendment of the charter of the city of Medford, Ore don, providing for ihe levying of as sessments on property benefited thereby, for laying wnter mains in the streets of said city, nnu provid ing for the payment of such assess ments in installments, anil for the is suance of water main bonds by said cilv, irrespective of any limitation or restriction contained in said charter on the power of said city to issue bonds or other evidences of mdebt cdness, and providing for the terms and conditions of said bonds. Ill A charter amendment to the chnrtor of the city of Medford, Ore gon, providing for assessing real es tate for the cost of sprinkling streets on which said real estate fronts in certain instances. IV A charter amendment of the charter of the city of Medford, Ore gon, providing for the right of said city to take possession of real es tate sought to be appropriated and condemned pending the action for such appropriation and condemnn tion, upon making a deposit into court. V A charter amendment of the charter of the city of Medford, Ore gon, providing for the assessment for special benefits of property in said city owned by any school district of the state of Oregon or by the city of Medford. And Whereas, on said 10th day of May, 1909, the city recorder of the city of Medford, Oregon, in my pres ence did canvass the vote given for und against said amendments to the churter of the city of Medford, Ore gon, respectively; And Whereas, it was iiscertained and determined upon such canvass that there were 160 votes cast tor and 50 votes cust against suid amendment numbered I; and 183 votes cust for, and 50 votes cast against amendment numbered II; and 168 votes cast for, und 60 votes cast against amendment numbered III; and 167 votes cust for, and 61 votes cust against amendment num bered IV; und 174 votes cast for. and 53 votes cast against amend ment numbered V, now I, W. H. Can on, as mayor of the city of Medford, Oregon, in obedience to und by vir luc of the power vested in me by law, do hereby muke und issue this proclamation to the people of the city of Medford, Oregon, und do an imuuce and declare that the wholi number of votes cust in the city of .Medford at said election for and against the said amendments to the charter of the city of Medford was as hereinbefore staled; und that said amendments to the charter of the city of Medford each und all received the affirmative majority of the total number of votes cast thereon and en titled to be counted under the provi sions of law; und said amendments to the charter of the city of Medford hereinbefore mentioned and each thereof shall be und are in full force and effect from the date of this proc lamation, and the following is the full text of each of said amend - meats : AMENDMENT I. A rhiuier ninciiddinciit of the char ter of the city of Medford, Oregon, .unending t'clioit twenty-five (25) of nul charter. The citv of Medford doth ordain us follows : Section 1. That section twentv- five (25 1 of the charter of the citv of Medford be amended so as to read as follows: Section 25. The eitv council shall have power and authority, within the limits of the citv of Medford, to en act all ordinances and adopt all reg ulations, uot inconsistent with the constitution and laws of the state of Oregon as shall be needful or requi site to maintain and establish the peace, good order, health, cleanli ness, prosperity and eeneral welfare of the city. 1. To assess, levy and collect poll road taxes within said limits and within the Kaiits of any road district of which said city may bo a part, and 'to levy taxee for oity purposes aeon CITY NOTICES. all property made taxable by the laws of the state of Oregon ; also to lory such special benefit assessments upon real estate for opening, widen ing, extending, improving or sprink ling uuy street or for laying any sewer or water mum and lor any other improvement as they may doom just and equitable. 2. To borrow money, incur indebt edness, issue warrants and negotia ble bonds in the manner and to the extent in this act provided, and not otherwise. 3. To open, vacate, alter, grude and improve streets and alleys, and cause the same to be sprinkled, sur vey lots, blocks, streets and alleys and establish their boundaries and name and number streets and alleys. 4. To divide the city into wards and change the same at will, provided a change in the wards of the citv null not i.c made oftonei than once in two years. 5. To regulate slaughter houses and provide for their exclusion from the city or any part thereof, and to prohibit the deposit or accumulation of filth, garbage or refuse of any kind in any part of the oity. 6. To establish hospitals within or without the eity, adopt quarantine regulations, remove or quarantine persons afflicted with contagious or infeotious diseases and to adopt and enforce such regulations as may be necessary or proper to prevent the in troduction or spread of such diseases. 7. To declare by ordinance what shall constitute a nuisance, regulate, prohibit or abate the same and to make the expense of abating the same a lien upon the property where the nuisance existed. 8. To establish fire limits and pro vide what kind of buildings can be erected within said limits and to de termine what repairs may be made to buildings therein, and to condemn and remove therefrom dangerous or unsafe buildings and to prevent the erection of new or the repair of old buildings therein, and to condemn and remove therefrom dangerous or un safe buildings and to prevent tht erection of new or the repair of old buildings without having first ob tained a permit from the council. 9. ' To provide for the establish meat, equipment and maintainenee of a fire department or fire company. 10. To provide water for the use of the inhabitants of the city and to that end own, buy, sell, lease or con tract for property within or without the oity, to buy, sell, or contract for water to be furnished by third per sons to the oity or to the inhabitant thereof, and to control and regulate CITY NOTICES 12. To construct and maintain sewers, drains, gutters and when nec essary, to continue, construct ana maintain the same outside suid city and to control and regulate the use thereof. 13. For the purpose of carrying out any of the powers hereby granted, to appropriate and condemn any real estate, within or without the city of Medford. in the manner provided by statute for the appropriation and condemnation of private property for corporate or public purposes, una iwithout any election or vote of the voters or taxpayers of said oity be ing called or held thereon. 14. To regulate and control the storage of gun powder and other ex plosive and conbustible materials, the use of oil or gns tor lighting or hent-ins- purposes, and to regulate, control or abate the use of flues and chim neys or other apparatus which may be dangerous in causing fires, and to regulate the manner of building par titions and party walls and to regu late or prohibit the sale or use of fire crackers, bombs, rockets, etc. 15. To regulate and prohibit the I running at large of domestic animals and the discharge or use of firearms. 16. To regulate the rate of speed of all trains, cars, locomotives, vehi cles and horses. 17. To prevent und restrain riots, noise, disorderly conduct and disor derly assemblages and to prohibit the carrying of concealed weapons. 18. To regulate or prohibit the passage of any steam, traction or other engine or motor upon the streets, or any bicycle, tricycle or tandem upon the sidewalks. 19. To license, tax, regulate or prohibit bar rooms, drinking shops, billiard rooms, bowline alleys, dance houses and all places where spiritu ous, malt or vinous liquors are sold or kept for sale, irrespective of any general law of the state on this sub ject enacted by the legislature or by the people at large, provided that no license for the sale of spirituous, malt or vinous liquors shall be granted for anvlessamount than is or may bepro vided by the general laws of the state in force at the time of the granting thereof, and further provided, that aid oity shall not at any time license drinking shops, or other places where intoxicating liquors are sold, to soil intoxicating liquors on Sunday.
