To a layman, unversed in the subtle twistings of the
law1, it would Room that. John Nuveen & Company, the
Chicago '.hankers, who purchased the city's bonds, have
decidedly the best of it in the controversy with city offi
cials over the accrued bond interest. If the city escapes
the penalty of paying interest from the date of the bond
jssije, instead of Ironi the date or the delivery ot the bonds
it will be thorugh the saving grace of technicality.
The city's only loophole to escape paying interest upon
money it has not received as yet and may not receive for
ninny- months, is the fact that the contract, accepted by
the council and signed by the city officials, was not an
thorized by ordinance as required hy the city's charter
Kuveen & Company's original bid for the bonds was a
telegram reading as follows:

This bid was irregular in that no certified check ac
companied it. However, Nuveen & Company agreed to
send such check, if the contract was awarded to them. They
sent the following contract, which the city obligingly ac
cepted ::

the. city of Alcdford, Oregon, on the lsth day of June, IIHW.

The entire bond sale was subjected to criticism at the
time, but it was supposed that the city's interests were
amply protected and that the heavy discount. Cor handling
the securities was the best that could be done at the time
on account of the condition of the money market. The
contract itself was never printed until The Tribune printed
it Thursday. It differs from the original offer in that
it provides a flat commission of $18,000 instead of 3 per
cent, as in the telegraphic, bid. The significance of this is
seen when the issue at the bond buyers' dictation was cut
to 355,000. . ...J
The certified check consisted of a check for $18,250
drawn by John Nuveen & Company upon John Nuveen &
Company, bankers, certified to by the cashier of John
Nuveen do Company. In brief, it was a check given by
the bond buyer upon himself, certified to by himself, and
was all the security the city demanded or got.
Nothing is said in the contract about the payment, of
interest. Under it, the bond buyers can collect interest
from the date of the bonds, and not furnish the money un
til needed on engineer's, estimates for work done, thus
receiving interest for money not furnished.
Nuveen & Company sent their engineer here to look
over the situation. lie arrived about the same time that
the American Light & Water Company representative, ami
this concern was the lowest bidder in the lirst call for bids.
Nuveeit & Company took such an active interest in hav
ing the contract awarded to the American Light & Water
Company that it gave rise to the report that the two con

the bond buyers also sought to dictate the selection of a
source of water supply to the city, arousing thereby con
siderable criticism.
Nuveen & Company's entire course has been to take
advantage of the city all along the line, in the bid, in tin
check,' in the contract, in the construction, in the interest,
and there is no good reason for supposing that Hie con
cern will do other than demand its pound of flesh, if it
is possible to secure it. That such a crowd of sharpen
should have overlooked a vital technicality seems improb
able,-hut "the best laid plans of mice and men aft gang
