1 cut ion of agreements for the purchase
of water for the city of Med ford, Ore
',' gon, and the construction of pipelines
and reservoir, and providiug the terms
and conditions thereof.
The city of Medford doth ordain us
follows:
l, Section 1. That the mayor mid re

to the recorder ot the city of Medtord
which is to be retnrned in case this
proposal is rejected, or to bo hold in
case this proposal is accepted only until
such tune as a contract in due lurin

can he executed.

Exhibit B.
Specifications Medford Water Works.
General clauses:
1. The work herein contracted to be
done must lie commenced, within IT
davs after tho date of this contract
and sufficiently completed ou or before
the first day ot .August, 1909, to ena
bio the main pipeline below the "Brad
shaw Drop" to supply the city of Med
ford uninterruptedly; and tho en tin
contract must ho" completed on or be
fore November first, 10U.
2. Tiino being an es;ntial part of
(Ins contract, there will he charged by
the citv ot Medtord, to (ho contractor
after August. 1st, 1909, the amount, of
.10 for eitch and every day that, the
main pipeline, below llradshay Drop,
does lint supply water at the fullvralc
possible according to size and pressure
and the amount of .$"10 for each and
nverv dav that tho work is not wholly
ompleted after November 1, 3909, such
harges being hereby agreed to he-
tween the parties to the contract 'an

contractor shall be liable to the citv

to complete the work ns specified." If
the contractor shall have finished the
work sufficiently to enable supplying
water at the full rate as stated above,
from the llradshaw Drop to the citv,
prior to the Slst dny of July, 1909. at

of July, 1909, he shall be paid $."i0

pipeline supplies tho city with water
uninterruptedly between said dates.
Where in the opinion of the eng'in
eer for tho city, the employment of
skilled laborers is necessary for the
successful completion of the work to
bo done under this contract, then only
such as have hnd experienco in and can
show themselves to be skilled in thoir
particular line of work, shall bo employ
ed by the contractor, and whenever the
engineer in charge shall decide that, any
person whosoever, employed on any por
tion of the work, is incompetent, un
skilled, disrespectful, disobedient, diB-
orderlv, or in auv 'way detrimental to
the interests of the city, thea such per
son shall be discharged by the contrac
tor, and ii'it again employed upon any
portion of the work during its construc
tion. 4. The contractor must nre such
methods and appliances as. will, in the
opinion of the engineer, secure the bust
progress and results attainable, and
whenever the engineer notifies the con
tractor, in writing, that the appliances
used, and the methods adopted for per
forming the work are not suitable for
obtaining the best results, then the con
tractor shall immediately provide, Bnch
tools and appliances, and adopt such
methods for the performance of the
work an aro satisfactory to tho en gin
eer; but the failure of the engineer to
notify tho contractor that the before
mentioned tools and appliances are un
suitable shall not relieve the contractor
in any wny from his obligation to secure
the quality of the work set forth in
theao specification!!. "

any time to stop work on account of in
junction suits, or any sufficient cause
whatever, the cuiitraetor shall, upon
three days' notice in writing of such

21. Whenever the word "contractor"

Flans and Superintendence.
1'laiiH and specifications aro intend
ed to be explanatory of each other. All1
dimensions, materials, linos, grades, etc., j

specifications. Tho plans and specifi

ever thing, material, work, or skill:
which may be requisite to obtain com

not herein specifically mentioned, but

render tho works complete, of which
tho engineer shall be judge, shall be
deemed to be included iu tho various
prices bid by tho contractor, and must
lie furnished or performed by the con
tractor without extra charge.
Tosts.
Whenever tho engineer shall desire to
make tests of tho quality of materials
to bo used in the construction, the con
tract or- shall furnish, free of charge,
all necessary material, required for mak
ing Bitch tests.
Clearing and Grubbing.
Vor- a distance of about 14 miles it
will bo necessary to clear and remove
tho brush and small trees now covering
the ground along tho right of wny. This
clearing will bo mado for a width of
20 feet, or wider if tho engineer Bhall
so direct. Tho brush and trees will all
be cut close to tho surface of the ground
and removed ns t lit work proceeds. No
bunting will be required. No grubbing
will be necessary oxcept for spaco oc
cupied by tho trench.
Timber.
All sawed or hewed timber used in
any part of the work, except for pipe
line, ma v lie of common nativo fir,
sound and free from decay.
Cast Iron.
All iron castings, unless otherwise
specified, shall be made from a superior
quulity ot iron having a tensile strength
of not less than IS.Onfl pounds per
square inch. All castings shall con
form to the shape dimensions required
bv the detailed drawings to be furnish
1 bv the engineer, and shall bo clean
and perfect, without defects of any
.nut. All cast nigs aro to ho coated
with n paint of asphnltum or other ap
roved mixture,
Oomont.
The cement used shall bo the best
nalit v of Cortland cement, dry ami

rial, delivered in the original pack-

as shall afford tho engineer opportunity

Sand.
The sand used for making mortar.

Gravol and Broken Stone.
Either clean screened gravel, quart

mica mav be used for concrete work.

Standard of Moasuromont.
In making mortar or concrete, a bar

by measure. One of these boxes full of

consist of one part cement nnd two parts

rel of cement and two boxes of sand.
Concrete.
Concrete shall be composed of one
part cement, three parts sand and rive
parts broken stone or gwivel. Thorough
niixing-aud tamping will bo rigidly in
sisted upon.
Mortar shall consist, ot one part, ce
ment and two parts of sand. No mortar
is to bo used after the cement has tak-
n its initial set.
Reservoir Lining.
When tho work of trimming the bot
tom and slopes ami laying all the pipes

ibove. Before the concrete has set il

Asphalt Coating.
When the concrete has become abso
lutely dry. which will probably be in
three or four weeks after tho lining
concrete is finished, it is to receive
