Where in the opinion of the engin eer for the city, the employment of skilled In borers is neeessury for tho successful completion of tho work to be done under this contract, then only such as havo hnd experience in nnd can ! show themselves to be skilled- in their particular line of work, shall bo employ ed by the contractor, and whenever the engineer in charge shnll decide thnt any person whosoever, employed on any por tion of tho work, is incompetent, un skilled, disrespectful, disobedient, dis orderly, or in any way detrimental to the interests of the city, then such per-1 son shall be discharged by the contrac tor, nnd not again employed upon any portion of the work during its construc tion. 4. The contractor must nno such methods and appliances as will, iu the opinion of the engineer, secure the best progress and results attainable, and whenever the engineer notifies the con tractor, in writing, that I he appliances used, and the methods adopted for per forming, the work are not suitable for obtaining tho best results, then the con tractor shall immediately provide such tools and appliances, and adopt such methods for tho performance of the work as are satisfactory to tho engin eer; but the failure of the engineer to notify the contractor that -tho. before mentioned tools and appliances are un suitablo shall not relievo tho contractor in any way from his obligation to secure i ne quality or the work set forth in these specifications. o. At all times when tho work is in progress, either the contractor him self, or a competent foreman, must be in direct charge of thu work: a complete set of plans and specifications mimi also be kept upon the w.ork, and any irders given to a foremnn or superin tendent will be considered ns having heen given to the contractor himself. Oversight or failure on the part of the engineer or nnv of his author ized agents to immediately condemn or reject faulty or bad work or mnterial shall nut be implied or construed as nn icceiitnni'o of the sam., it such faulty work or material b"eomes evident be fore the final acceptance of the work uid release of the contractor from his obligation. it. In ease any extra work has to be done, the city reserves the right to let tho contraeffor doing the same to whomsoever it sees fit, unless nn agreement upon the prices for doing such extra work can no speed- ly reached between tho city nnd con tractor. IS. It is hereby distinctly under stood that the measurements nnd esti mates of the engineer are to be taken is final and conclusive evidence of the amount of work performed bfcho con tractor. 1 he lull men miro of compen sation to be received by tho contrac tor. The estimate is to be based upon the proposal for tho labor performed nnd material furnished under tho con tract, and iu accordance with these specifications, nnd whenever there, may be auy ambiguity therein tho engin eer's instructions shnll bo considered explanatory nnd shall be of binding force. 19. In order to prevent dispute nnd litigation, the engineer shall in all cases be the referee to determine tho nmount quality, acceptability and fitness of the several kinds of work and material which are to be paid for under these Hpecificntions, nnd to decide upon nil questions which may arise as to tho ful fillment of said contract on the part of the contractor, and- his decisions nnd I'terminntions shall be final and eon lusive. 20. It is hereby stipulated that if the work to be done under this eon tract shall be abandoned, nr if at anv time the engineer is of the opinion, and shall so certify to the city in writing, that I he work is unnecessarily delay ed, or that the contractor is violating the terms of his contract, or is not executing the contract in good faith, then the city shall have tho right to notify tho contractor to discontinue the work, or such part thereof as tlio city may designate, and to take possession of the work, and either re-let the same by contract, or furnish the necessary tools and appliances for completing said work under the direction of the en gineer, and if the cost of so completing the work is less than the amount due the contractor, the amount left, after deducting all the expenses for so com pleting the work, shall be paid to the contractor or his assigns, but if the cost is greater than the amount due the contractor upon his contract, then the contractor nr his sureties upon the bond shall pay to the city the amount of money that the expense of so complet ing the contract exceeds the amount due upon tho contract. 21. Whenever the word "engineer" is used herein it nhall be nnd is hereby understood to refer to W. J. Whenever the words "city" or city council are used herein, they shall be understood to refer to the corpora tion of the city of Medford, of which the citv council is the duly authorised agent. I , -. All dimensions, materials, lines, grades, etc , must be tu full accordance with these ttpevifii'iitious. Tho plans and specifi cations are intended to include what ever thing, material, work, or skill which may bo requisite to obtain com plete aud finished work; and anything nut herein specifically mentioned, but. which may bo fairly implied as in eluded in tho contract as necessary to render tho works complete, of which tho engineer hatl be judge, shall be deemed to be included in the various prices bid by the contractor, and must lie furnished or performed by the con- ' tractor without extra charge. Tests. Whenever the engineer slm'l desiro to I make tests of tho quality of materials to be used in thu construction, the con tractor shall furnish, free of charge, all necessary materia), required for mak ing such tests. Clearing and drubbing. For a distance of ajiout 14 miles it will be necessary to clear and remove tho brush and small trees now covering the ground along the right of way. This clearing will bo mado for a width of 20 feet, or wider if the engineer shnll so direct. Tho brush nnd trees will all be cut close to the surface of the ground and removed ns tho work proceeds. No burning will be required. No grubbing will be necessary except lor space oc cupied by tho trench. Timner. All iron eastings, unless otherwise specified, shall be made from a superior inalitv of iron having a tensile strength of not less than IS.Oftd pounds per square inch. Standard of Measurement. In making mortar or concrete, a bar 1 of :enieiit of not less than 100 pounds trross weiijht or tho equivalent weight of cement in sacks, will bo the unit of measure nnd is called herein one quart. 1 he contractor is to pro vide boxes holding four cubic feet each by measure. One of these boxes full of wand, struck measure, will be called one part of sand. Therefore if mortar is to onsist of one part cement nnd two parts sand the proper portion will.be ono bar rel of cement mid two boxes or sand. Concrete.
