proposition:
Medford, Or., Oct. 10 1 AOS. To
the Honorable Mayor nnd City Council,
Medford, Or. Gentlemen: In order to
give the City of Medford n feasible
plan for obtaining the absolutely pure
Big Butte Springs water, the under
signed submit a the following proposi
tion:
The proposition is to convey three
hundred inclu'B of this absolutely pure
mountain spring water, which is to be
appropriated just below the springs,
for a distance of about twenty-five
milea to a point about three miles north
east of Eagle Point, near the northeast
corner of Section 24, Township 3.1 south.
1 weBt, W. M., by means of nn elevated
pipe line, constructed according to the
plans and specifications prepared by
anil under the supervision of the city's
supervising engineer; thence for n dis
tance of about fiften miles to the city
through wooden stave pipe and iron
pipe, according to the plans already ap
proved by the supervising engineer for
the Wnsson (.'anon and Fish Lake ditch
propositions. This latter fifteen miles
introduces no new feu In res into the sit
nation, ns the engineer's estimates and
reports cover it fully. .In regard to
tho construction of the elevated pipe
line above mentioned our proposition in
detail 1b ns follows:
Rights of Ways.
Tho city is to secure rights of way
from the springs to Medford, provide
all necessnry intakes, catch basins and
construct tho fifteen miles of under
ground pipe line, reservoirs, etc., ac
cording to the recominendat ions already
mn3e by tho supervising engineer.
The undersigned agree to mnko the nee-

the bend of the underground pipe line
at the point referred to above, nenr

dred and Ten Thousand Dollars, ex

house to Medford, about ten miles in
length, size of pipe 20 to 2-1 inch pipe,
or steel pipe of equal capacity, to con
vey nt least four million (4,000,000)
gallons of water in 24 hours; ahio fil
t ration system and two reservoirs of
four million (4,000,000) gallons total
capacity.
City Furnish Pipe.
Second The city of Medford to fur
nish ami install complete, ready for op
eration, the pipe line, reservoir nnd
filtration system; also to furnish and
install pumps and motors to be attached
to end of pipe line at Medford to be
used in re-pumping water to Medford
reservoir nt an elevation of 200 feet
above Medford; also to install at points
to be designated by us between Gold
Kay and Medford 40 Tees and Gate
Valves, which wil be furnished by us.
Third The City of Medford to fur
nish all buildings, use of ground
owned by city, all machinery, pipe, tools
and appliances of every kind and de
scription now in use or contemplated to
be installed or used in city water plant;
also put in good condition, connected,
ready for us, present city steam pump
ing plant to be used in case of break
down or emergency in supplying water

Water Rates.
In consideration of Ihe above the
Condor Water & Power company pro
pose to furnish to the City of Medford
sufficient water for Medford 's use at
the present city water rates, said rates
nut to be increased except as directed
by the City Council as hereinafter pro
vided. Water rates to be the same as
the present city minimi, flat rate. The
rate per one thousand gallons t be from
II cents flown to .1 e. nts per one thou
sand gallons. Out of the revenue thus
derived, alter deducting opernting ex
penses, we propose:
First To deposit monthly in a bank
to the credit of the City of Medford
an amonnt equal tn the bond interest
on bonds issued for water system as
stated above; also in like manner de
posit an amount equal to the sinking
fund, as provided in bonds. Interest
to be paid montly out of revenue as
provided herein.
Secojri Tn case sufficient revenue is
not reuuzed in any one month from the
operation of the city water system to
pay the operating expenses nnd tho
monthly bond interest and sinking fund
as provided above; then in that event
said water rates shall be increased by
the City Council sufficiently to afford
sufficient revenue to pay above charges
each month, nnd said rates slinll remain
in force for one year, and until such
time that each month will afford at
least sufficient revenue to pay operat
ing e menses, bond interest and sink

J. L. Hamilton submitted a proposi
tion to bring water from Fish Lake, as
follows:
Medford, Or., Oct, 15, 190ft. Honor
able City Council, Medford, Or. Gen
tlemen: I herewith propose to furnish
the city of Medford with 300 inches of
water at tho intake of tho pipo line
on the north fork of Little Butte creek,
build the gravity wooden pipo line, in
cluding the head works, trenching nnd
back-filling nnd clearing, n 2,000,000-
gallon reservoir nnd a connecting pipe
line from the reservoir to the present
city distributing system for tho sum of
$204,100.
Specification.' The intake of the
gravity pipe line shall be at a point
on the north fork of Little Butte creek,
above the ford at the head of Hanley's
field, wooden pipe running thence to a
connection with the beginning of the
second survey to Medford by wnv of
Brownsboro, profile of said survey being
on file in engineer's office and marked:

gravity pipe line.
Medford. Or., August, 1903.
(Jrade of Line The wooden pipe line,
hydraulic grade line of which shall be
shown on profile above referred to, will
onnect with a reservoir at the lower
ml of that line, and wit continue thence
to the junction of Roosovolt avenue nud
East Seventh street, a total length of
Ki-iiieh machine banded wood pipe of
'approximately 23.3 miles. At the junc
tion of Itoosevelt avenue and East Sev
enth street the wooden pipo will con
nect with a 12-inch cast iron pipe, which
wil continue approximately 2300 feet
along East Seventh street to Riverside
avenue, whero it wil connoct with your
present distributing system.
The machine banded wooden pipe ;
shall havo an inaido diameter of ltf I
inches and shall conform with tho spec
ifications covering same, that governed
the tenders previously submitted to you
on August 0, 1!0S, now on file with the
city auditor.
Castlron Pipe.
The 12-inch cast iron pipe shall be
class "D" Xew England Waterworks
standnrd, or its equivalent, nnd with it
will be furnished and set tho following

One Id-inch to 12-inch reducer.
One 12 ineh to 8-inch reducer.

The reservoir shal hnve n capacity of
2,000,000 gallons and shall bo con
structed of concrete six inches thick,
with two coats of asphaltum on the in
side surface.
Four your information and so that
you may know am well equipped to
carry out the terms of this proposal
wil state that the Fish Lake Water
company has agreed to furnish the
amount of water herein offered and will
guarantee the city against all litiga
tion that may arise out of so furnish
ing this water; and also that arrange
ments have been made by which 0. B.
Vincent and the Kedwood Manufactur
ers' company will furnish nnd construct
the system as herein set forth.
Payment Each Month.
I understand that payments will be
made as the work progresses, monthly,
based on the engineer's estimate, as
follows:
Ninety per cent of the value of ma
terial furnished and work done to be
paid on or about the first of each month
for the material furnished and work
done during the preceding month; 10
per rent, or whatever may then remain,
to be paid 3o days after the work ha
been finished to the h1 isfnrt ion of the
engineer.
Owing to the upward trend in the
'market prices for the materials involved
hi this construction, I mut make this

DETIiOlT, Mich., Oct. 1(1. It is ro
ported here that a tram bearing 200
refugees from Metz has been hemmed
in by forest fires nud that all are prob
ably dead. Metz has been entirely des
troyed.
After the flames had surrounded
Metz Pttempts to save the buildings
of tho place seemed futile. Tho inhab
itants gathered at tho railroad station
and boarded a train for Millersburg. 20
miles away.
Word from Millersburg says that the
train was ditched three miles from
Metz in the heart of the burning for
est. The fires nre spreading rapidly, ac
cording to dispatches, which give re
ports of the fire, received here contin
ually. It is believed that a number of
small towns have been wiped out.
ALPENA, Mich., Oct. lfi. The whole
of northwestern Michigan is burning.
The flames already have swept four
counties nnd the loss of life is heavy.
It is believed that if reports could be
ohtained the results of tho fires would
to the most appalling in the history of
this part of the country.
Fourteen women nnd children are said
to have been burned to death at Metz.
There is practically no hope for tho 200
refugees who left the city on the rolief
train that was wrecked in the burning
forest.
One refugee who arrived from Metz
today says that very few escaped and
that he believes practically the whole

lives on the relief train wero John Vin-

three men stayed by the train and tried
to get it back on the tracks white the
passengers fled beforo the roaring fires.
This city caught fire by sparks car
ried here by the winds, it was thoifgM,

the flames wero controlled. Several
buildings were destroyed.

Extensive alterations in tho Miles
block, including n new modern front of
pressed brick, are to Lo made during
the next few months. Tho plans havo
already been drawn, and if no hitch
occurs actus! work commence about
the first of November, ltesides the now
front und a complete remodeling of the
interior, which will make the block
thoroughly modern in every particular,
an addition will bo built, doubling the
present size of the block by extending
it 30 feet further in tho rear.
A new feature of the building and
one that will bo eagerly welcomed will
be a large hall TjOxMO foot, suitable
for dances, parties and meetings of all
kinds. This will be the largest hall in
the valley.

and Cottonwood dam sites, to deter
mine the depth to which the founda
tions for the dam must be laid. This

Saloons Under One Head
Councilman W. T. Vnughn of Port
land submitted to the city council last
ovening an amended ordinance granting
a traucuise to the (lothenburg associa
tion to sell liquor in Medford for n
period of ton years. Tho ordinance dif
fers from the one published in Thurs
day's Tribune so far as Beveral changes
were made nt tho suggestion of conn
cilmeu at tho afternoon session.
The ordinance as amended provided
ns loMows regarding a monopoly
tho city:
Section 1. That from nnd after the
first day of October, 19(H), tho Medford
tloehenburg association is hereby grant
ed the right within the corporate limits
of the city of Medford, Oregon, to sell
ami other wise dispose of alcoholic, vin
ous, malt or spiritous liquors, drinks
and beverages from the period of ten
years from nnd alter the said first dav
of October, 1000, ami no other person,
firm or corporation shall at any time
tie granted a license or privilege to sell
such alcoholic, vinous, malt or spiritous
liquors within said corporate limits ilur
ing any part of said term or the whole
thereof, except the application of such
other person, firm or corporation be
first approved by a majority vote of the
qualified electors nf said city at nn
election held for that purpose; and pro
vided further, that no such other license
shall be granted for a shorter period
than ten years, nor for less license
fees than those hereinafter specified to
oo paid by said Medford Gothenburg
nssoeint ion.
Tho amended ordinance provided dis
tricts in the city as follows:
On De Anjou street between Sixth
and Might li streets, and on Fir street
between Seventh and Eighth streets,
except that this territorial restriction
shall not apply to nuv bona fide hotel
hereafter constructed containing 75
rooms or more.
The third change made was one pro
viding for an inspect ion of liquor in
stock by a duly authorized inspector:
Section Hi. Tho snid city shall at
all times have the right to employ an
inspector for the purposo of inspect
ing all liquors and stock nn hand be
longing to said Medford Gothenburg as
sociation, which liquors and stock on
hand shall at all times be open to said
inspector for such inspection, and in the
event that said inspector find any of
such liquors or slock on hand impure or
unfit for constumption, said city may
forthwith confiscate and destroy such
of said liquors or stock on hand as may
bo so found impure or unfit for con
sumption. 'lie council indulged in much disc-is
sion of the ordinance, finally referring
it to a committee composed of Eifert,
Merrick and Olwell.

certified cheek, as Mr. Hade had seen
in n morning paper an incorrect state
ment as to the time nf closing the
aeceptanee of offers. The bid wns not
eiitertuineil, as no water was ofiered.

lows:

Mrs. Hearst Runs Scream
ing Into the Aisle of Car
When Door Is Broken
. OMAHA, Neb., Oct. 10. William R.
Hearst was served with papers in a
suit for $000,000 damages brought by
Governor Charles N. Haskell of Okla
homa (lis he was passing through this
city enrly today.
A deputy sheriff with tho papers
boarded the train, but found tho door
to Hearst's stateroom locked. He
knocked on the door and Mrs. Hearst
said that her husband had gono to the
station to send a telegram.
The sheriff nnnounced that he would
force his way into tho stateroom if tho
door were not opened. There was no
response. The officer then, using his
shoulder ns n bnttering ram, forced the
room and almost fell into tho room.
Mrs. Hearst Frightened.
Mrs. Hearst, partially dressed, rushed
screaming into the aisle of the ear.
The officer wns not dismnyed by tho
sight of the freightened woman or her

door. He probably would have broken
this door down in a few seconds if
Hearst had not appeared and accepted
service of the papers.
After the exciting scene, which nenr-
ly caused a panic among tho pnssengera
of the train, he advised that the sum- .
mons was unexpected nnd he had no
idea what the man wanted. He said
that he had refused the officer be
cause he and his wife had retired nnd -
that they were not prepared to receive
strangers in their private apartments.
Mrs. Hoarst Recovers.
M rs. Hearst quickly recovered her
nmposuro, but remained in tho state
room.
Hearst said that he had no idea of
avoiding service and asserted that tho
aggressiveness ot t he ott icer was en-
tireh unwarranted.
The suit was filed at 10 o'clock last
night nnd the papers were immediately
