Mr. -Mills for the petitioners toxk tin roninl t hat in the mutter of the peti tion of the voters to itnlor an election to vote mi the tpnstion of local option, the record not show l certifioate of I lie clerk that the persons sinin were leal voters; that the sheriff V certifcale of the posting of notices of the elect iim was iusutlicienl. in that u return tl'u not say where I he not ices were posted, huf only that t hey were posted in five public places iu the vi cinity of tin polling places; nlsn that the abstract of the votes should havi appeared in the record of tin county court to rie jurisdiction to make the final order declaring the result of the vole. On the part of the det'endants, Mr. iSlune contended that the law did not rc(.ii ire a cert ii'icate of the clerk that the voters who signed the petition were iu:lil'iei! voices, hut that such petition was for the county court, and when the court had satisfied itself that the pet i tiou complied with the law it was its fluty to make the order for the election; that the return made by the sheriff and clerk with reference o their compliance with the law, being prima facie evidence that all the provisions of the law had been complied with, made the work done exempt from an attack by writ of review. Also that it was not necessary that thea bslract made of the volt1 should be included in the order declaring the re suit uf the election; that such abstract was made for the information of the county court, and was not a jurisdic tional matter. And that then rder de claring the result of the election being prima facie evidence that nil the pro visions of t he law had been complied with in giving notice of and holding said election, and iu counting and iv Uirning the votes and declaring the re sults therei.f. the proceeding could not be al tacked by writ uf review. RUN OF SALMON IN COLUMBIA IMPROVES ASTORIA, Or.. .Inly S During the past few davs t lie run of salmon has improved considerably and there is now every indication that this season will be a better one than last, for the canuers al least. The majority of the fish ma iling now are small, which always gives evidence of a new run of fish that have just left the sea. They are firm and hard and of the best quality in every way. That last season's pack will be excel od now practically conceded by those rpost interested, unless the unexpected should happen. MOVES MERRILL SALOON AND RUNS FREE BUSSES A. F.
