Medford Man Lodged in Mult
nomah County Jail Charged
With Perjury In Land Filing.
Charged with perjury, James T. Ha
zel wood of Med ford was lodged in the
Multnomah county ,uil yesterday in de
fault of $200 bmids, Htntes the Portland
Oregon inn of Juno 24. Tim receut fed
eral grnml jury returned an indict ment
against Hazel wood, charging, him with
perjury in making application for a
homestead in Jaehsori county in Jnlv,
innn.
Tn the invest igat i on of the charge
against Hazel wood, B S. Ken ins of Jack
son county was the complaining witness.
It wns represented by Keums that he
was the owner of a mining claim that
had been worked satisfactorily for prob
ably for 15 years, and that TTnzelwooil.

stead, subscribing to a non-mineral af
fidavit in support nf the application.
Later Hazel wood relinquished his claim
and never attempted to make final
proof.
Numerous instances of this eharaeter
had beenicnlled tn the attention of Tint
ed tSntea Attorney MeCourt, who con
cluded tn present the facts before the
grand jury for its consideration. The
result was that a number of indict
ments were returned and Hazel wood
wns included among the defendants.
The practice of these men, t is alleged,
wns to seek to acquire possession of
valuable mineral lauds by filing on the
same as homestemls. Tn order to do so
it was necessary to subscrjbe to a non
Tnineral affidavit, declaring that the
land wns non-niinoml and not suited for
mining pursuits. By this process several
instances were reported in which min
ing claims were jumped and the origin:)!
owners were ousted from their biddings.

the county court of Jackson county in
the matter of declaring the city of .Mid
ford prohibition under the local optio;i
law there has been a movement among
the saloon men of this city to start b'gal
proceedings that would prohibit t he
county court from declaring the cily of

local option law in accordance with the
vote of the county al the recent elec
tion, states the Klamath Tails Herald.
The first step in this direction was
taken yesterday when Kent Ballard and
A. Cast el, through their a1 tonieys, I
IT. Mills and A. I,. Leuvitt, filed a peti
tion in the circuit court asking for a
writ of review, making County .fudge

hase the defendants. The writ will come
before Judge Benson as soon as ho can
find time to take up the matter, and this
will likely be before t he first day of
July, as according to the order of tin
county court prohibition goes into effect.
The outcome of the caso will be wan lu d
with much interest. The matler oi'
granting the writ will in hsMf r.ol stop
prohibition from going into effect, but
if the writ is granted it is very proba
.ble that n restraining order will be is
sutd, and if this done the nn loons will
continue business nut il the matter is
finally settled.
In the petition are set forth a number
of reasons why the writ should be grant
ed, but chief among it hem is that the
local option law is superseded by the
charter of the city of Klamath Tails.
The local option law was enacted in
Juno of l!Hi4, while the city charter was
not enacted until the following year.
This places the case practically on a
par with thnt of Medford. except that
the charter of this city does not con
tain the clause delegating to the city
the power to regulate, license and pro.

gardless of any other state lay. The
appendix, "regardless of any other state
law" is not affixed to the clause in the
-charter for Klamath Tails.
The petition cites error on the part
of the comity court in making the order
for the local option election nml also in
declaring the result of the election.
