I! i' : THE MKDFOUlr DAILY TRIBUNE, MEDFOWD, OKKUON, WEDNESDAY, JUNE 10, 1008. Medford Daily Tribune A LIT Paper In Live Town. Published erery evening except Sunday Medford Publishing Oompany. O. PUTNAM, Editor and Manager. Admitted as Second Class Mailer in the Postoffice at Medford, Oregon. Subscription Bates: One month, by mall or carrier. . .0.60 One year, by mail 6.00 'MAJORITY SULK," Great stress is Inid by dry town ad vocates upon "majority rule, and they would .ignore the rights conferred by the legislature upon the city council enabling it to rcgulatn citv nffuirs in order to put iuto effect their thoo riet, upon th iirgumcnt that a major ity of the people of .Tncknon county know better how to govern Medford than a majority of her own cilixcus. . If the majority .control, surely the majority of Medford citizens should hare the right to control the city's destinies, nnd a majority of citizens voted AgnlnBt a dry town .luno I. Why hould Ashland, actuated by rivalry and desire to put Medford in lis bad a fix as she is herself, and people living m the country 40 miles nvriy, be per oi it ted to regulate city affairs here! There is no reason or justice in it. Majority rule, under the Oregon lo cal option law, is a furce. To secure a majority for prohibition, two or three precincts are combined, two dry and a wet, to mnke the wet one dry, when an overwhelming majority in the wet precinct vote the other way. Thus University Park, a church and school settlement, is tacked onto the city of St.. Johns, and though St. Johns voles solidly wet, It is "painted while" by the votes of the residents of unolher city, who pay St. Johns no hues nud have nothing in common with her citi zens. v The same sort of majority rule pre vails in Jackson conuty. Medford is not segregated lo vote separnfely upon prohibition, but n stretch of prohihi tiou territory, including Griffin Creek, ia included in the city precincts to vote the city dry. Yet in spile of the dry votes of farmers, a mnjorily here voted wet. Such is the "majority rule'' of the prohibitionista majority heeded onl, when it Is bis own way of thinking, BEWABD OFFFEBED FOR BLIND PIG ARRESTS There is much consternation nmong the. ten saloon malingers of Mrnnt Pass, since Monday's election, when i Josephine county went dry by n major ' ity of 500 votes. ; At first' a few of ' the saloon men1 were inclined In figli it out in tlf' courts, declaring Ihey - could not be forced to close their places. They buve since decided, however, close their saloons. A few of them, is said, will establish drug stores nud elubrooms. Others will move their 'fix .tnres out of town. Homo will hourd up their windows. In order to prevent the running o "blind pigs," an organization Grants Fass citizens tins been former to see that thelaw is enforced. Th organization has raised a fund and will hang up u reward of several hundred dollars to be given anyone who will famish testimony convicting the opera tor of a "blind pig.'.' Sheriff Hussr states that If ho Is hacked bv the ell zens he will see that the local option Jaw is strictly enforced. Grants Pass, being a mining town has always been considered a wet town, and most of the saloon owners are me who have been in business here for years. The several saloons occupy th best locations in the business part o town, and most of the liquor places arc elegantly equipped. There is also large brick brewery owned nnd mnn aged by a woman. The brewery ships out little of its beer. BENSON TO SUCCEED OUB OEOROB AS GOVERNOR rrank H. Benson, governor of Ore . gon and secretary of state, thai is tin way it will read after the legislature ot ivuv Has oleeted George E. I 'number Iain United Slates senator nnd lie lia resigned his office ns governor to as sume me mines or the scnntorxlnp mm Aiarcn. According to the constitution of Ore gou the office of governor falls to Un let of the secretary of stale in cote the regularly elected governor. f,.r am reason other than the cipiriiliou of his term, atiouM cease to exercise the fane lions of his office. Therefore when Governor Chamberlain steps out of the governor's office to niiume the scna torial toga by virtue of the legisln turn's election in January, Prank S. Benson, secretary of slate, will become by that fact the acting governor of Oregon. kfOKB MONEY FOR SOLDIERS' WIDOWS , COMMUNICATION. To the Editor: The Medford Mail in Tuesday's issue eoincs out opets)y and defends the purchase by the city, of Mr. Ha u ley 's water fights in Was son canyon. Whutever jnuy be said of rlie judgment displayed, the Mail's bump of editoriiU. courage has evident ly expandeil, which is certainly coin meadable. It will be noted Unit Ihis editorinl dodges two of the principal points at issue, namely,' that the water is and always will be contaminated by stock running at.-large, the purchase inelud ing no land for' fencing or otherwise protecting it, nud the fact that the city is paying it'J..,nil for iilmnl one half of Mr. Haulev's waler rights, when his entire farm of over B00 acres. eluding all water rights, was listed fur nilc fur 12,0(K). ..Besides, J. W. Sliu ger's ranch, with water rights probably superior tu Mr. Ilanley's wus for sale and conk! have been secured for $7000, which fact was known to the water committee. The Mail 'a Defense. The Mai) bases its defeuse on two assumptions: Firsl, that there Is tide tpiate water in Wasson canyon to aup ply Medford, or Mr. Ilanley's indem nity bond will reimburse the city; nnd, second, if tlie supply proves insuHi- cicnl nfter the pipeline is established mid the money expended a sufficient Supply citlf be obtained from Little Butte creek. In February, when -llie Medford rep resentatives visited Wasson ennyon, there wits without doubt plenty of wa ter there, and it was probably pure enough for domestic purposes. At that time of the year the same was true of llry creek, which in the drv season Iocs not supply water enough to keep toad nlive. Home of our best and inosl reliable citizens declare that in the driest seasons there is very little water in Wasson creek. One man slates thai lie has seen this strenm so nearly Irv that Ihern was not sufllcient water lo supply a drink for his saddle horse. 'I he only competent evidence in such uses is Hie testimony of reputable tier- solis who have seen I lie stream iu dry weather. A preponderance of the proof is to the effect thai' Ihis canyon docs mil furnish enoui'li water lo ioioolv Medford, Furthermore, the water sun- iily lor Ihis city should, like Caesar's wife, be above susDicion. A Questionable Supply. What right have the authorities to pay .l'3,0llll of the pic's money for a questionable wuter supply, when this counlry is full or beautiful streams nf fording plenty of pure waler' Prohii Idy not one eily east of the ltorky m tains is supplied with water lis good as Itogue river affords. A stand pipe gravity system could be estab lishcd for probably u smaller sum than (.Iihijioii. Again, Fish lake ami nig Untie ii in both available. Why did the city council, not get estimates on a supply from one" 'or more of these sources before purchasing Ilanley's gold lirick 1 As to the legal effect of the contract i nd iiidemiiliy huml, I may not be us "ompelcill to judge ns th litor of the Mail, but 1 will soy this: I will vuger ifllill that under the provisions of these documents the cily cannot col tci't a cent of indemiiily from llnnley even if there proves to he less than 100 inches of" waler in'Wns-ion canyon. There is at least one huge joker in the contract, and lioiid. All riparian rights are exempted from Ilanley's guarantee. The city would be compelled In con 1 ii and pay for these riparian rights, in addition lo I lie ifLVi.llwl purchase price. Butte Creek Water Taken. Hut what authority has the Mail lor Hiving thai water can be secured Iroiu l.iltln lliitlo if ,e Wasson sup ply is already owned? After the pipe Hue is laiil and the city a funds ex hniisted, how could it get additional water from the owners of Little Untie! Is such a course good business indir men! ! Does anybody believe for a mo ileal that Die city council would adopt ind pursue such a business policy in a nrivale venturer Does anybody believe Mini the water committee would hnv paid $l!."i,0(0 of their own money for such n water right as Mr. Ilnnley owned in Wasson amy mi f The cily council is morally if not legally bound to work lor tlie host interest, of I lie city nud its people. The council is composed of men who do mil bito at bunco deals in poi-sniinl transactions. Why should thev illow I hi' cily lo lie honcocdf W. K.
