They in turn mn into Charles Dunford's
del ivory wagon, upsetting it and com
pletely demolishing the same, Fortu
nately, no one was injured, both wag
ons being left standing.
Jacksonville has another real estate
firm, W. W. Irving & Co.,-who have
their offices opposite Ryan's store.

and curbs to conform thereto, and pro
viding penalty for violations thereof.
The City of Met! ford doth ordaiu us
follows:
InitiaD. Bench Mark Where Located
Section 1. The U. 8 G. S. bench
mark, which is a round disc set iu the
west wall of the Nash Hotel building,
at the southeast corner of Seventh and
D streets, and which has an elevation
of 1370.00 feet above mean sea level,
is hereby declared to bo the initial
bench mark for the City of Medford,
Oregon.
Other Bench Marks When Located
Section 2. For the purpose of perpet
uating evidence, there shall be estab
lished within said city not less than
eighteen other permanent bench marks,
which, with any additioual bench marks,
shall be located by the City Eugiueor,
who shall file n record of the same
with the City Recorder, which record
shall accurately describe and identify
all such marks.
Standard Grades
Section 3. The regulation of the
standard grades for Eighth, Ninth,
Twelfth nnd Thirteenth streets, from
the main track of the Southern Pacific
company to Riverside n venue, and for
Tenth and Eleventh streets from said
track to C street, and for D street from
Seventh street to Thirteenth street, and
for C street and Riverside avenue from
Seventh street to the sonth corporation
boundary of tho City of Medford, and
for B street from Seventh street to
Ninth street, shall be and are hereby
declared tn be as indicated and speci
fied by tho maps and profiles adopted
by the City Council in regulnr session
the 0th day of January, 190S, and now
on file in the office of the recorder
of said city.
Grades to Be Established Hereafter
Section 4. At such future times as
maps and profiles of the grades of
streets and avenues in said city other
than those above named shall be ap-i
proved by the City Council nnd filed
in the office of (he Citv Recorder, thou!
'such grades as indicated by said maps
and profiles shall, by such approval of
said na aud profiles, be deemed the
established standard grades of such
streets aud avenues.
Sidewalks and Curbs to Conform to
Orade and Line
Section 5. AH sidewalks and curbs
hereafter constructed in the Citv of
Medford shall be made to couforin to
the standard grade aud line of the re
spective streets and avenues of said
city.
Penalty for Violation
Section 6. Any owner or owners of
property abutting or bounding on any
of the streets and nwuues of said City
of Medford who shall refuse or neglect
to comply with the provisions of this
ordiuance shall, upon conviction there
of, b punished by a fine of not less
than five dollars nor moro than twenty
dollars, and shall pay tho costs of the
prosecution.
Alteration by City
Section 7. Iu the event that any
person convicted of a violation of tho
provisions of Section 5 of this ordi
nance shall fail or ncgleet to niter such
sidewalk or curb to eon farm to the
standard grade aud line as herein pro
vided within thirty days after such
conviction, tho City Engineer may cause
such alteration to be made, nnd cause
t he expense t hereof t o be assessed
against tho property abutting against
such sidewalk or curb, nnd such expense
shall be a lien against said property
and shall be enforced ns is provided for
tho enforcement of n lien for the im
provement of n street.
Section ft. All ordinances and parts
of ordinances in conflict herewith are
hereby repealed.
The foregoing ordinance was passed
by the City Council April 7, 1908, Trow
bridge voting nye, ICtfert aye, Wort man
aye, Merrick aye, Olwell absent, TTnfer
absent.

PROCLAMATION".
Whereas, there was submitted to the
voters of the City of Medford, Ore
gon, nt n special election held for t lint
purpose on April 3, 1908, a proposed
amendment to Section 72 of tho City
Charter of said City of Medford, and
Whereas, on the said 3d day of April.
190S, tho city recorder, in the presence
of the City Council of said city, did
canvass tho votes given for and
against the said amendment; and
Whereas, it was ascertained and de
termined upon such canvass that there,
were 36S votes cast for and 22 votes
cast against the said amendment, and
that said amendment received an af-;
firmative inajoritv of the total num-j
ber of effective votes east thereon nnd
entitled to bo counted under tho pro-1
visions of the law;
Now, therefore, I, B. J. Trowbridge,,
as acting mayor of the City of Med-1
ford, Oregon, in tho absence of thej
mayor from the city, in obedience to,
and by virtue of tho power and au
thority vested in me by law, do hereby
mako nnd issue this proclamation to
the people of tho City of Medford, and
do announce nnd declare that the whole
number of votes cast in the city of
Medford at said election, for and
against the said amendment, was as
hereinbefore stated, and that the said
amendment received the affirmative
majority of tho total number of votes
cast thereon and entitled to be counted
under tho provisions of law, and that
said amendment shall be and is in full
force nnd effect from the date of this
proclamation, and that the following is
the full text of the said amendment:
Amendment to Section 72 of the City
Charter of the CHy of Medford.
The People of the City of Medford do
ordain ns follows:
That Section 72 of an act of tho leg
islalure of the State of Oregon, en
titled, "An act to repeal an net un
titled. 'An act to repeal an act en
titled. "An act to incorporate the town
of Medford, in Jackson county, Oregon,
and limiting its powers nnd defining
the duties of its officers," and to re
peal nn act entitled, "An act to incor
porate the town of Medford, in Jackson
otinty, Oregon," approved February

all amendments thereof, and to Incor
potato I he City of Medford, in JaclvSon
onnty, Oregon, and to define its pow
er and duties, approved February fi.
1901, and to incorporate the Citv of
Medford, in Jackson county, Oregon,
define its powers nnd duties, and to re
peal all nets and parts of acts in eon
flict herewith," filed in the office of
the secretary of state, February 7, 100.1,
is amended by the act amendntorv
thereof, filed in the office of the sec
retary of state February 13, 190,", nnd
as further amended by the vote of the
people of Medford on Juno 4, 1907, nnd
on March 17. 190S, be and the same is
hereby further amended by adding
(hereto the following:
Subdivision I. In addition to the
foregoing warrants nnd bonds, as au
thorized in the r receding subdivisions
of this section, the said council is fur- j
ther authorized to borrow money nn thej
faith of the city, and for that purpose
th issue ndditionnl warrants and bonds
for the sole purpose of securing, furnish
ing nnd installing a gravity supply of
pure water for said citv; but in the.
event that snid council shall elect to(
