illE MEDFORD DAILY TRIBUNE MEDFORD, 01?., THURSDAY, MARCH 12, 1908. AMUSEMENTS, "Tie Black Crook" Tonight. The Sacramento (C'al.) Union of Tut'S- dv, March 12, has the following notice of tie "Blai'k Crook," which holds the board or the Medford Opera House to night. The Union's critic has the rep utation of being quite n "roaster," and company getting a good write-up from aim ut certain to deserve it: "The revised 'Black Crook' at the Cluaie last night was not bo much re vised after all. It had more up-to-date longs, imitations and skits and hits; otherwise it was the old ' ' Black Crook FILLBASKET APPLE QUITE WELL NAMED r SPOKANE, Wash., March 12. K. MeCorinaek, uu oroliunlint uoar Zillnli. Wash., gout Invest of Spokane, lias just made the discoverv that tlie Kentish Fill basket, an old English apple, will thrive better in this country than it! does in itn native soil. This upsets the ( pet theory of expert horticulturists inj various parts of America and is of im portance to fruitgrowers everywhere. Tho trees, designated its Winesnps. Tho new "Black Crook" was all it was announced to be, rich in costumery, brilliant in scenery, lively as to ballet, and overflowing with specialties, from modern songs and hits to fine imitations and some really caolce singing. Notable were J. Ed ward Pierce and Marie Roslvn in op eratic selections, which won tho hearty applause of a not over-numerous nudi once. C. W. Kelp, the low comedian, was very clover, nml tho Donazettas, Eorapeon acrobatic troupe, was very superior. Better work in that line is rarely if evor seen on this const, and seldom, indeed, is it equaled. What tho ballet lacked in beauty it atoned for in grace nnd agility, and it was quite a singing chorus also. In short, the new "Black Crook" came fully up to promise, and though far from oa great as in its initial dates, when it wan common to stage it with 100 people, it was thoroughly enjoynlile and interestingly reminiscent. pies were put nwny until a fi-w days ami. when Bruce Wees, a widely trav eled apple buyer, declared they were of I j the Fillbflskrt variety, grown almost exclusively in Kent. The apple is large tinl in of cream color, lightly speckled. Twelve apples tako up as much room ns 3.1 ordinary ones. Mr. Wees says the drawback to tho trees in England is that they bear only every third vear, but Mr. McCormnck be lieves thry can be made to yield an nually in this country. At nny rnte. he is saving the scions and will inula ;i thorough test tho coining season. HOMESTEADERS GET BEST OF LAND OFFICE EULINQS There is renewed hope on tho part of homesteaders in the Southern Oregon pine timber belt. In several decisions rendered by the land offico at Lake view and sustained by the genoral land office the homesteader on lands valued chiefly for timber received the worst of the deal, and the timber and stone ap plication was given tho preference. Re cently, however, in a contest decided by -'the acting commissioner of the gen eral land offico, the decision was strongly in fuvor of tho homesteader, nnd the acting commissioner held thnt the homestead entry should hold re gardless of the character of tho land or the amount of timber thereon. All that is necessary is for the homesteader to show good faith in compliance with the laws governing homestead entries. In case of conflict between a timber and stone application and a homestead entry, the former always dwells par ticularly upon the' character of the land, snowing by expert testimony that the land cannot be cultivated and that it U practically worthless after the tim ber is removed, and .the effort is al ways made to prnvo bad faith on the part of the homesteader. Whether these grounds are sufficient for ren dering decisions adverso to tho home steader is a matter that will likely be In litigation for years. Those who en tered the land rush expecting to secure valuable timber lands without a hard struggle are finding the fight for lands strenuous, and far more expensive than batf been anticipated. The actual cost of a contest is from $300 to $500, de pending upon the prieo of the lawyer Vand the amount of evidence introduced. BEING YOUR.
