This farce of a trial is largely the
outgrow! h of the ;iw enacted a few
years ago at Die behest of the prose
cuting attorneys' lobby, abolishing the
grand jury system, except in special
instances at the discretion of the prose
cutor. It has inaugurated a system
under which that official has powers
in criminal matters that tend to cor
ruption and bribery. Kven when a
grand jury has been munitioned, as in
the .Medford case, its members are ab
solutely dominated, if not actually bull
dozed, when ner Miry, by the all -powerful
district attorney.

It is the inalienable right of a news-
filter to eriticiwe any person holding
public office or performing public du
ties, if that person is derelict or un
true to the trust reposed in him. In
leed, this is not only the right, but
the duty, of a newspaper, and if it
fails to call attention to the delinquen
cies of public officials it censes to ile
s rve the confidence of the people.
Ill the performance of what he
deemed his duty to the people of his
community, George Putnam, editor of
the Medford Tribune, criticised a local
grand jury and the district attorney
for failing to indict a man who had
been guilty of a murderous assault.
I he grand jury retaliated by indicting
the editor. .Now behold the unutter
able farce that was enacted when his
case came to trial.
Putnam desired to prove that the
murderous assault was comuiitled. This
he had to do in order to show that
the grand jury failed in its duty when
it omitted to indict the man guilty of
the assault, ami that his editorial criti
cism was consequently justified. Hut
the court refused to admit this evidence
on the ground that tin- question whether
in assault had been committed was res
judicata ; that inasmuch as the grand
jury had concluded that there was no
assault, their conclusion could not be
asa-dlcd. In other words, when the
grand jury had acted no newspaper
had any right to question the correct
ness of their conclusions. '
It would be difficult to conceive of
any more pernicious or more dangerous
judicial decision than this. It aims a
direct blow at the freedom of speech.

he reach of censure or criticism. This

believe it is law.
Olwell Hughes, Enol Kilkey and
Randall Hood, Grants Pass debating
team, holding the negative, defeated
the Rosebnrg team, consisting of Carl
ton Spencer, Will Thornton and Ruth
Gibson, on: "Resolved, That the nat
uralization laws of the Tailed States
should be made more stringent."
Judges were William Colvig, W. S. Cro
well and M. A. Martin.
At Medford the Klamath Falls team
defeated Medford on the same ques
tion, but the affirmative one. The two
winning teams will debate at Grants
Pass, next Wednesday.
KANSAS CITY DEPOT
DESTROYED BY FLAMES
KANSAS CITY, Jan. 13. The Union
stat ion annex building adjoining the
I'nion Railway station, was destroyed
by fire early today. The Cnion sta
tion is one of Kansas City's landmarks
and was saved after a hard fight by
the firemen. The fire burned the build
ing containing the offices of the ex
press companies, the postoffice branch
and the eating-rooms of the V; M. C. A.
The toss is a quarter of a million of
dollars. ( 'rossed electric wires in the
mailing room of a branch post office
caused the conflagration.
