definite atcion was taken by the Su
preme court tortny in the matter of
the Sunday cloning of theaters, when
a motion was denied for a rehearing
of the hubeaa corpus case of Frank
II. Donnellua of Seattle. In the Her
ald case, from Tacoma, two months
Hgo, the 8uprenie court sustained the
validity of the law prohibiting the
atrical entertainment . on Sunday
Theuter owners all over the state he
came Interested at once and the dis
covery was made that the original
law which was passed In territorial
days had exempted anohomiah coun
ty from Its provisions, which It was
contended made the act a special law
prohibiten, by the constitution. A
test case was, therefore, made by
the arrest of Donnelian, a Seattle
theater manager, and the Institution
of habeas corpus proceedings on his
behair. The Supreme court held that
the law, when copied Into the code,
omitted the Snohomish exception and
nn Its adoption became a new and
.'slid act. As a final move the theater
people then asked a rehearing, which
