volver, locked one of them In a
clothea closet and tied the other to a
chair with ropea, after which be
rode a distance of 109 mllei Into
Spokane, pending three hour and
40 minutes rifling registered mail,
loading and unloading mail sacks
along the route and puffing complac
ently at a cigar the while.
The lone robber dropped olt the
train at a railroad crossing inside
the cltw limits, carrying with him
It la believed, much valuable plunder
In a satchel. Just how much he ob
tained la not definitely known.
Mall Clerka Benjamin Stumpt and
John W. Nysteun, who were held at
the mercy of the robber, tell a re
markable story of their experience.
Locked In the small closet, hardly
two feet equare, the latter almost
fainted from suffocation after the
train had palled into Sand Point, (4
miles went ot Bonnera Perry, and
rapping on the door pleaded with the
robber to allow him some fresh air.
The bandld responded willingly and
leaving the door ajar about an inch,
secured It with a piece of rope. Twice
later on the way Into Spokane the
robber ceased his work of rifling the
mall sacks to go to the door of the
closet to Inquire as to how Nysteun
was feeling.
When Stumpf remonstrated with
hla captor that the corda which
bound him were cutting his wrists,
the genteel robber generously loos
ened the fetters and made every ef
fort to make things as comfortable
aa possible for his victims.
While ripping open the registered
sacks the pseudo-Inspector cut one of
his fingers and many of the pieces of
mall were blood-stained. Blood
hounds were put on the trail of the
robber, taking the scent from one of
I the bloody packages, and followed a
trail several blocks through the resl-
donee district to a cnrline, where the
' scent was lost. It Is believed that
i the lilKhwnymnn boarded a car and
rode downtown.
I When the train reached Spokane,
j John Nysteun, one of the postal
i clerks, was found locked In the
clothes closet, where the robber had
i put him, while Benjamin Rtumpf, the
other clerk, was helpless under the
table with a Jumper drawn over his
head and his arms tightly bound.
It waa then that the story of the rob
bery waa first learned.

John I. Wells, Frank Martin, and
others, returned by the. Federal
grand Jury here, has rendered a
decision sustaining the second of two
pleas In abatement filed and argued
before him by the .defendants. This
la the plea in which District Attorney
Rulck was charged with misconduct
before the grand Jury that returned
the Indictments.
The other pleaa filed by specific
defendanta, one claiming that the
statute of limitations barred prosecu
tion and the other that immunity
was procured because of testimony
given by defendants before the grand
Jury, are overruled. The effect of
the ruling la to throw all of the cases
resulting from the grand Jury Inves
tigation of March, 1807, relative to
alleged timber frauds, out of court.
The defendants were John I.
Wells, Patrick Downs, John Klnk
ald, Louis M. Prltchard, William
Sweet, Albert E. Palmer, Horace S.
Rand, Frank Martin, James T. Bar
ber and Summer O. Moon. Senator
Borah was Indicted with these, but
stood trial and was acquitted.

A Rio Orande went on strike yester
day In response to aa order from W.
O. McQueeny, representing the ma
chinists' National organisation. Man
ager A. C. Rldgeway, of the rail
road, had refused to make any eon
cessions In a conference.
"The strike will ultimately spread
to every road In the Oould ayetem
and affects roads all over the United
States," said Mr. McQueeney. "There
la every Indication that the struggle
will be a long one and fought hard
on both aides."
The strike la the result of an order
posted by the road a month ago
abrogating all contracts with the
unions. Since that time numerous
conferences have been held by the
men and the company, but It waa im
possible to reach an agreement.

day. They molested and threatened
men going out on the train to the
creek to work and prevented railroad

evidence to warrant a thorough prob
ing of his charges that the Electric
Boat Copany ot New Jersey used Im
proper moans to influence legisla
tion In its favor.
The congressional committee,
which waa appointed by the speaker
to investigate the Lllley chargea,
promised the latter that if he ahowed
that there were good grounds for
bis accusations, the committee would
call witnesses.

clares that the submarine torpedo boats
are a failure.
According to Ulley's present plans
he will ask that Isaac L. Rice, presi
dent ot the coat concern; Ellhu
Frost, Its vice-president, and Law

moned. Spear, according to the charges
made by Representative Hobson, Is
the man who offered him a place on
the naval affairs committee If he
"stood right" on the question of
submarines.
President Roosevelt, in a special
message to the Senate, calls attention
to the fact that the Senate commit
tee has found that the charges of
participation in the Brownsville riot,
which caused him to dismiss Com
panies B, C and D of the Twenty
fifth infantry, were substantiated,
and asks the Senate to pass a special
law extending for one year the time
within which those who establish
their Innocence may be reinstated.
Such a bill will be introduced.
Senator Heyburn has secured the
passage through the Senate of his
bill providing for the survey ot all
public land, reserved and unreserved.
In Idaho, Oregon. Montana and Cali
fornia. Under the present system,
the Government only surveys land
upon request of actual settlers. Mr.
Heyburn says this ayetem tends to
retard development, and also retards
surreys, aa settlers don't like to go
on unsurvoyed land.
He will confer with the Oregon,
Montana and California Senators and
have an amendment made to the
sundry civil bill appropriating suf
ficient money to begin tbese surveys.
He wants $100,000 for Idaho.
The fortifloatlons appropriation
bill, which will soon be reported to
the House, will make adequate pro
vision tor lnsreaelng the efficiency of
the coast defenses along the Pacific
Coast. It Is stated that the entire
appropriation, save what Is necessary
for maintenance of defenses on the
Atlantic coast, wUI be devoted to
the enlargement and Improvement of
the Paclfle Coast and tnsaUar de
fenses, several million dollars In all.
