7. During the last three days the Rus
sian bombardment has been heavier
than at any time during the past six
weeks. For two days following the
receipt of General Stoessel's letter to
Oenersi Nogl offering to surrender
Port Arthur hardly a shot was fired,
but since then many heavy guns have

almost constant firing.
There is no indication of the mean
ing of this activity on the part of the
Russians, apart from which conditions
at the front remain unchanged. ' The

.made no overtures tor peace to Rus
sia, directly or lndlreatly, through the
United States or any other power, and

to press the war In the north all the

Japanese armies at"ttao Tang with
the greater part of the troops which
have been besieging Port Arthur.
At the Ruaslsn embassy It was re
iterated that Russia would fight all
the harder in view ot the temporary
loss of Port Arthur.
Europe, u is learned, is firmly of
the conviction that however dark the
outlook for peace at this moment,
when the prospect brightens it is to
President Roosevelt that the neutrals
as well as the belligerents will loo:t
as the intermediary through whom
peace -negotiations will be initiated.
Tokio, Jan. 7. General Stoessel,
the Russian commander at Port Ar
thur. ' has acceDted the Darole offered
by the Japanese and has started for
Russia by v, ay of Nagasaki.
The mlkauo has ordered that all the
military honors payable to a Japanese
field marshal shall be rendered to
General Stoeasel. Only eighty of the
Russian officers who surrendered at
Port Arthur have been paroled. All
the Russian regulars marched out of
the fortress yesterday.
London, Jan. 7. A special dispatch
from Tokio Bays that at the conclu
sion ot the Interview between Gen
erals Nogl and Stoessel, tbe latter
begged to be allowed to present to

charger. General Nogl courteously de
clined personal acceptance, pointing

of war material to be surrendered, but

Henry Milton Takes the Connt
at San Quentin and Sing

Ban Quentin, Jan. 7. Henry Miller,
Silas Larry O'Nell, alias George Lup
ton. ascended the scaffold yesterday
at 10:81 a. m. and eleven minutes later
was pronounced dead by Prison Phy
sician Casey.
Two minutes before he .mounted the
gallows Milton asked Warden Lusnp
klns tor ajdgarette, whtch he smoked
as be climbed the stairs, and continued
to smoke until It eras taken from him
to permit of the Mack cap being placed
over his head.
As the warden took the cigarette
from him Milton muttered; "Let me
go to smoking."
He was game to the last, and kicked
oft hie : slippers as he was going
through the trap, as he did not want
to die with his shoes on.

Guards Ben Merrltt and J, K el ley of
the death watch stated before Milton
went to his death that he reaffirmed
his confession that he was responsible
tor the brutal robbery of Mrs. Mat
thews and that Mike Nolan and Docia
Nolan were entirely Innocent and had
no hand in the robbery.
He did not want any minister or
priest to attend him, but at the re
quest of Father Walsh of San Rafael
to attend him on the scaffold he offer
ed no objection,' so Father Walsh was
present. i
To the death watch, Ben Merrltt
and J. Kelly, he stated that he was
well connected, and came from a good
family, but would not state who hlB
people were, as he did not want to
bring disgrace upon them. He stated
that he "was bad through choice, as
there was no necessity for it. His exit
from the world at the end of a rope, he
said, was his Just reward. .
. The crime for which Milton was
hanged is the murder of James Gtlllee,
an aged saloonkeeper of San Fran
cisco. After closing his saloon Galilee
walked along Ninth street, near Mar-J
net, waen u neii aeia aim up. uuuee
refused to submit to the robber, and
was shot in the groin by O'Nell.
O'Nell was Immediately captured by
the police, being held by GUUce until
their arrival. Death came to GUUce
the following day.
Sing Yew at Foliom.
Folscm, Jan. 7. Sing Yow, the con
victed murderer of Jeong Him', walked
to the gallows yesterday morning as
calmly as though he was going for an
outing In the Jail yard. No tremor of
nervousness was apparent and he met
his death with all the stoicism ot his
race. While he stood on the trap and
the rope was belag placed around his
neck he calmly looked over the gather
ing of officials on the stone floor ben
neath him and said: "I tell you peo
ple that I am a good man and never
killed anybody."
' Then the trap waa sprung, and in
seven and one-halt minutes life was
sxtlnct.
The murderer passed an easy night,
slept soundly, ate a hearty breakfast
and displayed not the slightest con
cern over the fact that the shadow ot
leath was fast creping over him. This
indifference may be accounted for by a
statement he made to Constable Don
nelly when that officer was taking him
lo the Institution after his conviction.

ifter I am dead, and I'll kill all of
Lhese fellows who got me kilied, you
bet your life."
The murder for which he died was
committed at Walnut Grove, Sacra
mento county. In October, 1902.
Sing Yow had trouble with Jeong
Him over a gambling debt, said to be
lue from deceased. They wrangled
iver it for some days and other Chi
nese took sides. .
Finally the enemies of Jeong re
solved that a short way out of It would
oe to kill him. They accordingly sent
tor a gang of highbinders to do the
deed and two or three of the toughest
of the order came from San Francisco
and San Jose for the purpose. The
gang waited one morning In front of a
Chinese restaurant where Jeong waa
breakfasting. When he came out they
at once fired upon him with pistols.

tory yesterday In tbe first fight over

Amid the greatest confusion they
passed a resolution creating a com
mittee of fifteen ineatbere, twelve of

Yesterday morning the legislature
went Into joint session. Confusion at
once resulted when Lieutenant Gov
amor Haggott, the presiding officer of
the senate, took hla position beside
Speaker Dickson to direct the joint
session. Mr. Dickson refused to give
way.
"The clerk of the house will call
tbe roll," said Speaker Dickson with
a thump of b gavel.
. "Tbe clerk of tbe aenate will call
the roll of tbe senate, said Lieuten
ant Governor Haggott,
Immediately the two clerks com
meoced to call the rolls amid great
confusion. But few names had been
called when Representative Frewec
arose. ' -
"Mr. Frewen has the floor,' shout
ed Lieutenant Governor Haggott with
a thump of his gavel.
"Mr. Frewen, you are out of order,"
shouted the speaker. I
"Mr. Frewen, you have the floor,"
repeated Lieutenant Governor Hag
gott Bang! Bang! went the two gavels.
The two men stood side by side be
hind tbe speaker's desk, both refusing
to give way. The confusion was so
great that no voice could be heard,
and although Mr. Frewen continued
to address the assembly, his voice
was not distinguishable.
A motion to adjourn was made and
seconded. It came to a vote, tbe ayes
and noes sounding In about equal vol
ume. ' 1
"The ayes have It, and the joint ses
sion is dissolved," shouted Lieutenant
Governor Haggott.
"The noes have It, and the motion
is lost," shouted Speaker Dickson.

ernor's gavel,
"The assembly is not dtssolved,"
called the speaker. .
"I repeat that the session Is ended,
and the senators will leave the room,"
said the lieutenant governor, and out
filed the senators, headed by the lieu
tenant governor, amid great confu
sion. Many of them did not leave the
room, but stood behind the seats of
the representatives, watching the pro
ceedings. Speaker Dickson refused to recog
nize the passing out of the senate, and
ieclared that although the senate had
'eft the room the Joint session was
still In progress.
Representative Frewen raised re
peated points of order to the effect
that no Joint session was being held
and waa promptly ruled out of order
every time by the speaker. A roll call
was finally obtained on the point of
order that no joint session was In
progress, and It was declared lost by
a vote of 49 to 6.
Representative Griffith then present
ed a protest from Governor Peabody
against the manner in which the last
election had been held. As soon as
tne reading was finished Mr. Griffith
rlemanded a roll call on the adoption
f the resolution. Sixteen members
if the senate responded to the roll
iall, two of them present declining to
vote. When Senator Morgan's name
vas called he declared that the treat
ment given to the presiding officer of
.ue senate hau been an insult, but he
would vote for the resolution rather

part.v The resolution was adopted by
a vote of 51 ayes, noes 1, the negative
vote being cast by Senator Wood.

A ball of beeswax Introduced Into
the shell of a living fresh-water mus
sel has resulted in !' producing the
moat remarkable artificial pearl in
existence. It is about- an inch and a
half in length, oval In form and pink
in olor, and la now the property of
the Smithsonian Institution, reports
a Washington exchange.
The ball of wax was placed near
the hinge of the bivalve, which being
in a tank of fresh water, was care
fully, watched. The irritation of the
wax caused the mollusk to protect
itself by coating the foreign object
with a smooth coating of pearl stuff
the same material as that which Is
used In lining the inner surface of its
shell. In the case in question the
result was an enormous pearl. Owing
to pressure, however, the wax ball
lost Its spherical shape and become
oval tai form.
At the end Of two years the mussel
was taken out of the tank and opened
and the pearl remored. The wax
afterward contracted owing to dry
ness, which caused the pearl shell to
crock. . This accident, while destroy
ing the commercial value of ' the
pearl, made It possible to observe the
thiokneas of the nacreous covering,
which is somewhat greater than that
of an ordinary sheet of letter paper.
If the pearl were not flawed U would
be worth an enormous sum of money,
but even as It is It la priceless as a
curiosity.
