A 91 00 Suit.
Within the precincts of Justice Wal
ton's court this week there has been
aired about every ill and woo of the
"honest worklngman" to which
'human flesh is heir to."
Lewis Bolus of Brownsboro sued Geo.
W. Morine of Brownsboro, in the sum
of fifty cents a day for several days as
rccompenc3 for damage sustained by
tho aforesaid Boles, by reason of the
aforesaid Morine forcibly retaining in
his posossion certain wagon wheels
which had been sent to the said Mor
ine by the said Boles to bo repaired,
said Morine retaining said wheels in'
lieu of tho sum of $'1.00, tin same be
ing the. value the said Morine placed
upon the labor he performed in repair
ing said wheels, aud thereby "liangs
tho tale."
It seems that a contract was consu
mated last summer between Morine
and Boles, tho consideration of which
was a wagon, a watch and the repair
ing of tho wheels of the said wagon the
following summer.
Morine owned the wagon and Boles
tho watch and they swapped, Morine
agreeing to repair the wheels of the
wagon, as leforesaid, the following
summer. All went well until tho re
pairing clause in tne contract came
due. Bolt's sent the wheels to Morine
to b-e fixed, but aft?r tho repairing was
done Morine refused to give up the
wheels until he had been paid M.00 for
the work he perfo-u.ed, did uing thtt
the watch iu the trade had not come up
to the standard agreed in thj contract.
Boles brought suit to recover tin'
wheels and the damage he sustained by
reason of their non-delivery.
The suit consumed the belt :r portion
of two days. Judge Willard Crawford
being retained for the plaintiff, while
S. S. Pentz did the honors for the de
fendant. A juryof six was imitan ! .d
and after listening to lengthy and bril
liant remarks by both attorneys aud a
learned chnrge by the judge, they were
retired and in about fifty minutes re
turned a verdict for the plaintiff in the
sum of Sl.i'fl.
