Early Notice and Public Review of a Proposed Activity in a
100-Year Floodplain
To: All interested Agencies, Groups, and Individuals
This is to give notice that the City of Union, Oregon has conducted
an evaluation as required by Executive Order 11988, in accordance
with HUD regulations at 24 CFR 55.20 Subpart C Procedures for
Making Determinations on Floodplain Management, to determine
the potential impact that its activity in the floodplain will have on the
human environment for the Water System Backup Power and Sys-
tem Control project under Community Development Block Grant
Number P200005.
The City of Union (City) has proposed updating the City’s water
system with electrical and control system upgrades at a former For-
est Service compound north of the intersection of La Grande-Bak-
er Highway and North 1st Street in Union, Union County, Oregon.
The upgrades will include digging a 2-foot wide trench that extends
from an existing utility shed to the far east side of the North 1st
Street right-of-way, installation of utility lines within the trench, and
reestablishing the grade and surface conditions of the trenched
area. The Site encompasses 0.294 acres, with approximately
0.214 acres in the 100-year floodplain. The right-of-way and City
former U.S. Forest Service property are primarily gravel, pave-
ment, and/or lawn grasses.

Floodplains provide a number of natural benefits that include but
are not limited to fish and wildlife habitat, natural flood and erosion
control, surface water quality maintenance, groundwater recharge,
and biological productivity. This project is not intended to negative-
ly impact any of the previously developed project Site.
There are three primary purposes for this notice. First, people who
may be affected by activities in floodplains and those who have
an interest in the protection of the natural environment should be
given an opportunity to express their concerns and provide in-
formation about these areas. Second, an adequate public notice
program can be an important public educational tool. The dissem-
ination of information about floodplains can facilitate and enhance
Federal efforts to reduce the risks associated with the occupancy
and modification of these special areas. Third, as a matter of fair-
ness, when the Federal government determines it will participate
in actions taking place in floodplains, it must inform those who may
be put at greater or continued risk.

SUMMARY OF RELIEF REQUESTED: Plaintiff is re-
questing the court award: a money judgment in its favor against
the Estate of Dona Dee Stanbro for the sum of $22,880.00, plus
Plaintiff’s reasonable attorney fees, costs and disbursements; a
declaration the trust deed be declared a lien upon the property
benefitting Plaintiff for the amount of the money judgment; a judg-
ment and decree that the trust deed be foreclosed and that the title,
claim, interest, or demand of defendants and each of them in said
property, and every part thereof, except their statutory rights of re-
demption, be foreclosed; a judgment that the Property, with all of
its appurtenances, rights, privileges, and easements be sold on ex-
ecution by the Sheriff for Union County, Oregon, after giving notice
as required by law; that Plaintiff may be and become a purchaser
at said sale; that the Sheriff give the purchaser thereof a Certificate
of Sale and, unless the Property is redeemed before the expiration
of the redemption period, a deed; that said purchaser have imme-
diate possession of the Property, and every part thereof; and that
said purchaser be entitled to such remedies as are available at law
to secure such position, including a writ of assistance, if defen-
dants or any other parties or persons shall refuse to immediately
surrender possession to the purchaser; and a judgment directing
the proceeds of the sale be applied as follows: first, to pay the costs
and expenses of said sale; second, to pay the judgment of Plaintiff;
and third, the overplus, if any, be paid to the Registry of the Court
subject to further court order.
