US Supreme Court
Gives Setback to
Nevada Divorces
WASHINGTON, May 21 (UP)
The supreme court held today
that each state may decide for
itself whether to recognize the
validity of the six-weeks resi
dence under which Nevada grants
divorces.
The 6 to 3 ruling, written by
Justice Felix Frankfurter, af
firmed the convictions of a Pin
eola N. C, couple for "bigamous
cohabitation."
The couple O. B. Williams
and Lillie Shaver Hendrix
twice were convicted in North
Carolina courts.
They went lo Nevada in 1040,
established residences there for
six weeks, obtained uncontested
divorces ;,t Las Vegas from for
mer spouses, then got married
and returned to North Carolina.
The state of North Carolina re
fused to recognize their Nevada
divorces.
"North Carolina was entitled
to find, as she did, that they did
not acquire domicile in Nevada
and that the Nevada court was
therefore without power lo lib
erate the petitioners from amena
bility to tiie laws of North Caro
lina governing domestic rela
tions," the court opinion said.
