Union County.
By authority of the Oregon Horti
cultural LawB and by order of the
State Board of Horticulture you are
hereby notified to spray all cherry
trees on your premises (owned or
leased) for the eradication of the
Cherry Fruit Fly.
You are hereby notified that the
correct tim" to' e application of
second spray is June 38th.
The poison spray or bait is compos
ed of powdered lead arsenate 4
pound, molasses or syrup 2 quarto
(never honey) and water 8 gallons.
Apply the spray In fine droplets on
the surface of the outer leaved at the
rate of 1 pint to the tree. '

sidewalks, or either, of said city, for

restore the same to good order and
condition as soon as practicable and
without any unnecessary delay, at
the cost and expense of grantee, it
successors or assigns, and on failure

for the whole city or for any district
or portion thereof In which it Is Im
mediately proposed to carry on con
struction work.
Section 7. Nothing In this ordin
ance shall be construed In any way
to prevent tho proper authorities or
the city of La Orande. Oregon, from
sewering, grading, paving, planking,
replacing or repairing or otherwise
Improving or altering- any of the
streets, alleys, highways or sidewalks
of said city, but all such work shr
be done, if practicable, so as not Ij
obstruct. Impair or prevent the froe
use of said pipes or other apparatus,
of the grantee, Its successors or as
signs, and the Installation of the
Works of the grantee shall in no tray
obstruct, impair or prevent the free
use of any underground works pre
viously installed by any other franchise-holder.
Section 8. In consideration of the
privileges, and franchise granted by
this ordinance, the said Natural Oas
Corporation of Oregon, a corporation,
for itself, its successors and assigns,
agrees to defend all actions, and if
damaged be awarded, to pay all dam
ages, resulting from Injuries sustain
ed by reason of any excavation, In
BtnUatlrn of mains or other appli
ances used by it or under its exclu
sivc control. ' - "
Section 0. It Is hereby declared
that the City Commission of the city
of La Orande estimates that the fair
compensation for -this franchise to
the olty of La Orande Is two pctl
cent: (2f) ot the gross earnings of
me grantee, aeriveu irom servtco to
its patrons now or hereafter located
within tho City of La Orande, aame
to be paid, as herein provided,, in
annual installments, not later than
sixty (60) days after the end of the
period covered by the payment; that
the estimated total cost. of the works
proposed hereunder Is 240,000.00, and
that the yearly sum to be expended
is approximately $10,000.00; that the
maximum rate to be charged by
grantee hereunder shall be 93.00 per
thousand cubic foot; that' the grantee
of this franchise, ite successors and
assigns,1 shall commence actual con'
struction work hereunder In good
faith not more than thirty day from
the effective date of this ordinance,
and shall, within two months after
commencement of the work (Unli

plant, together with s distributing
system which Is aotually delivering
gas within the corporate limits of
said city; provided, however, In the
event the grantee, iu successors ox
assigns, shall be prevented from or
delayed In commencing or completing
said work within the times .Herein
specified, by reason of any litigation
or other causes beyond its or their
control, the time for the performance
of said work shall be extended for s
period equal to the period of such
interference or delay, and provided
further, that the City Commission,
for good cause shown, may extend
said time from month to month, not
exceeding six months, by an order
entered- In Its Journal, unanimously
concurred In by three members of the
commission. It Is also specially un
derstood and agreed tht subject to
the provisions hereof for extension
due t9 delays beyond the control of
the grantee. Its successors and as
signs, and the other provisions re
lating to extensions, the franchise
herein granted shall be declared to
be and the same shall be forfeited
If the construction worjc Is not com
menced and completed within the
times herein specified. ; .
Section 10. The grantee herein, for
Itself, Its successors and assigns, cov
enants and agrees with the city or
La Orande, a municipal corporation,
that in consideration of the granting
to it of the rights and privileges em
braced In this Ordinance. It will pay
to the city of La Orande, Oregon,
two per cent (2) of the gross a-
nual revenues derived after the fire
day of January, 1034, from service to
its patrons now or hereafter located
within the city of La Orande, Oregon,
same - to be paid In annual install
ments not later than sixty (60) days
after the end of the period covered
by the payment, and that It will
furnish the city, at the end of each
such period, a verified statement of
it sold gross earnings, and that it
Wilt allow the Inspection of Its books
at all reasonable hours upon demand
of the Commission.
In further consideration of this
franchise, the grantee will, with Its
acceptance, file with the city a surety
bond in the amount of 1 ,000.00, con
ditioned upon the faithful perfor
mance- of the terms and conditions
of this Ordinance during the period!
of Its existence. - -
Section 11: Every charge, rate, fee
or compensation made or demanded
by the grantee of this franchise for
any service rendered or to be render
ed shall be Just, fair and reasonable.
The Public Bervice Commission of
Oregon shall have the power to de
termine what rates, charges, fees and
compensations made, charged or de
manded by said corporation, are un
just, unreasonable. Insufficient or un
justly discriminatory or preferential.,
and to fix those Which are Just, reas
onable and sufficient.
Section 12. The rights, privileges and
franchises hereby granted to said
Natural Oas Corporation, a corpora
tion, Its successors and assigns, shall
continue and be In full force and ef
fect for tho full period of - twenty
(30) years from and after the taking
effect,' Including acceptance, hereof,
and are hereby granted subject to alt
the terms, Conditions and restrictions
of the charter, of the city of La
Orande, Union County, Oregon, now
in effect, except so far as such terms
may be modified or superseded by the
Constitution or laws of the State of
Oregon or of the United States.
-Section 13. This ordinance shall
be inoperative unless accepted In
writing by the grantee and filed with
the City Recorder of La Orande with
in forty days after the passage of this
Ordinance. ' , .
