can cast a ballot in the May primaries.' Voters who have
not changed residence and who voted in the last general
election are already registered and need not worry. The
avst should give registration immediate attention. Under
the party system as it operates in Oregon, the results of the
, primary election frequently determine the results of the
general election in the fall. It is generally agreed that the
republican nominee for governor will be elected barring
Joseph as a possibility so the May election is of utmost
importance.
7. PROHIBITION MORE AN ISSUK !
Whether prohibition was an issue in the presidential cam
paign of 1928 is a nooted question, but that it has become an
issue of no little moment under the Hoover administration,
which is dealing with it by commission, none can honestly
deny. Public sentiment was never more crystallized nor the
opposing battle lines more tightly drawn.- , M
There is a significance that cannot be ignored in the house I"
judiciary committee hearings, in the widespread interest in
the prohibition polln being cqnductod by newspaper and aj
magazines and in the Massachusetts and Rhode Island M
referendum. i J
Nothing political or in a legislative way may come from all pj
this. ,. Congress shows no inclination to tackle new prohibi- M
lion legislation at this time, limiting its program to the major
recommendations of the Wickershain commission. Here and J
there Btate legislatures may turn "wet" or "dry" in a legis- eg
lative way and some local political campaigns nuiy be waged
about the 'standards of these two antagonistic causes.
Most trouble over the situation is felt by the candidates
for congress. Congressional elections this year, many
observers think, will come nearer to being a national referen
dum on the issue than lias yet bear had. Few candidates
will get through the .1930 campaign themselves on this
"burning issue."
OWNERSHIP OK THE AIR
Ownership of land no longer includes everything from the
mirth's core to the liniit of the sky, the Massachusetts su
preme court has ruled in a test ciisc to determine an aviator's
right to skim the housetops.
The court gives the landowner full and undisputed author
ity over the air above his property to a height of 100 feet,
above which is public right-of-way. Of course that ruling
does not give aircraft the right to crash into that portion of
skyscrapers and other structures above the 100-foot limit.
Here is a decision that requires some interpretation. Itj'
cannot possibly mean to establish a legal limit or settle the j
ownership of the air, for there are obviously many conditions
under which a thousand feet or more might be the minimum
margin. In fact the flier who threw overboard a monkey-
wrench at a height of 25,000 feet would be guilty of trespass
or something.
The ruling is in answer to a complaint against pilots who
skim the housetops too closely for comfort and safety.
Wherever there are airports surrounded by houses this com
plaint is common mt without justification, in spite of the
few accidents that have occurred.
While the court's view is of interest to proicrty owners, it
is of considerable significance to aviation, which can see in
it the foicrunncr of many other restrictions if pilots persist
in a reckless disregard fur the rights and safety of othei-s.
