are Defendants, said decree being in
favor of said Plaintiff and against
said Defendants, it is therefore ord
ered, ADJUDGED AND DECREED
that the plaintiff have and recover
Judmont and decree against the De
fendant Malinda C. Earls, in the sum
of $149.26, and for tho further sum
of $117.50, being accrued interest to
November Cth, 1916, and for inter
est on the said principal sum, to-wit:
$149,26, at the rate of 8 per cent per
annum from tho 6th day of November,
1916, until paid and for the further
sum of $75.00, as plaintiff's attorney
fees, and for the cost and disburse
ments in this suit incurred, and taxed
at $64.15, and for the accruing cost,
and that the said Mortgage be and
the same is hereby decreed to be
prior in time and superior in right,
to ny right, title or interest claim or
lien, or any claim of any right, title
or interest, or claim or lien, of the said
J i defendants, or either or any of them.
Therefore I will on the first day
of October, A. D. 1917, at the hour
of 10 o'clock A. M. of said day at
the front door of the County Court
House at La Grande, Oregon, sell to
the highest bidder for cash at public
auction the following described real
property, to-wit: .Lots 1 and 2 in
block 22, Chaplins Addition to the
town of La Grande, Union County,
Oregon, the proceeds of said sale to
be applied as follows, to-wit: (First)
to the payment of the expenses of
execution and sale, the cost and dis
bursements of this suit, including the
Plaintiffs attorney fees herein, and
the accruing cost; (second) to the pay
ment of the judgment herein, together
with interest fTom the 6th day of
November ,1916, at the rate of 8 per
cent per annum until paid, and for
the further sum of $117.50, being ac
crued interest to November 6th, 1916,
the balance if any to be paid into
Court, and disposed of as the Court
may direct.
Dated at La Grande, Oregon, this
31st day of Aug., 1917.
