We came very near losing one of
our prominent townsladies to New
York this week. One of the Marine
iband members was so fullsome in his

who asked him if he enjoyed his din

will spend about three weeks with
their father in Sheridan.
Mr. and Mrs. Peter Biever have re
turned from a very pleasant trip to
Los Angeles where Mr. Biever was
present at the national convention of
Knights Templar. They had an en
joyable trip fraternally and otherwise
Mr. Biever is ready to resume his
engineer's run again after the extend
ed vacation.
M. C. Haun and family who have
been residents of La Grande the past
four years left on No. 6 today for
Salt Lake.
Mrs. B. Lodsdon and Mr. and Mrs.
W. C. Kelley went over to Union to
day to be in attendance at the funeral
of the late Mrs. Wm. Burford.
Mrs. A. L. Rice, wife of Railway
Station Agent Rice of Enterprise, is
in Ii Grande on a short visit.
J. F. Campbell is transacting busi
ness in Union today.
Attorney J. F. Green was a pas
senger today to Idaho where he will
be absent for a short time on busi
ness. Carrol Currey and Nell Bradley
have returned from San Diego where
they have been attending a leading
normal school the paBt year. They
report that the wave of military pre
paredness has struck Southern Cali
fornia points in a most marked man
ner; that business is generally abated,
and that professional and businessmen

Editor Observer) I am enclosing
copy of letter I have written to our
Representative in Congress, Mr. N.
J. Sinnott, and if the suggestion con
tained therein meets with your ap
proval I shall be glad to have the co
operation of the local merchants to
ward correcting this abuse with which
practically every merchant is fa
miliar. The matter of presenting bills for
undercharges long after the mer
chants' goods have been disposed of
has proved a source of great annoy
ance and loss to them of vast sums
of money in the aggregate.
A letter to Mr. Sinnott by those in
terested would assist materially.

ington, D. C. Dear Sir: "It is a poor
rule that does not work both ways" is
an axiom.
Section 16 of the Interstate Com
merce Law provides a limit of two
years after which an overcharge can
not be collected from a railroad but
no such limitation against a railroad
collecting an undercharge from a
shipper. If an error in a freight bill
is discovered any time after shipment
is delivered the railroad must under
the law, if it is an undercharge, ex
haust its legal remedies to collect it.
As an illustration of the many com
plaints brought before this Commis
sion, aggregating large sums of
money, an Oregon firm was asked the
other day to pay $20 undercharged on
a carload of fruit shipped in 1909.
The law as it has been interpreted by
the courts and the Interstate Com
merce Commission holds that pub
lished tariffs speak with equal au
thority to the 'shipper and the carrier
and that both are equally chargeable
with notice and knowledge of the
rates. Insofar as it intends to pre
vent indirect rebates and diserimina-
tion it is, of course, commendable, bufc-

demands and safeguard, thn interests
of the public.
Ihe average merchant has neither'
the time nor the opportunity to ac
quire a proficient knowledge of theJ
tariffs that affect has business. Many
tariffs are so complex and technical
that even traffic experts fail to cor
rectly interpret them. This being
true, it is unjust and unreasonable
that the merchant should bo held re
sponsible for the- application of er
roneous rates.
The local agent of the company iit
presumed to be conversant with tariff
and rate matters. The auditor's of
fice has a force of trained experts
whose duty it is to check the billing,
detect and correct any errors that
may have been made by the local'
agent. With proper attention this

weeks after deliveiy. Therefore, I
am of the opinion that carriers should
bo required to demand at the time of
delivery all charges dut for the trans
portation of property and that they
should be estopped from collecting
any sum for whichi demand has not
been made within a period of ninety
days after delivery.
I lielieve that one of the bills now
pending before Congress should be so
amended ns to definitely prescribe the
duty of the carrier in this respect end
fix the time limit of ninety days in
which demands for undercharges may
be made.
