by holding a series of conferences

' "Kidnapper" Dismissed.
Pendleton, Jan. 13. The sequel to
the recently aired kidnapping case in
Milton was the trial yesterday after
noon in the circuit court of David M.
Bennett, who was accused of assault
ing Mrs. Joe Sullivan. It was an ap
peal from the Milton justice court
where the defendant was found guilty
by Justice Miller and sentenced to pay
a fine of $30. The jury, which heard
the case yesterday, returned a verdict
of acquittal at . 6 o'clock, having
-reached the verdict on the first ballot,
it is said.
The trouble . arose over a family
quarrel.- Bennett's son, ' Albert,- aad
Mrs.' Sullivan's daughter are married
and -have a child. They were not liv
ing, together and, Arnrng ,the absence
pf young : Mrs.'; ' Bennett rom her
mother's, home,, the two men called,
as'they testified, to- get the young
wifti'tb return to her Husband. They
tortttte&hat Mrs. Sullivan ' ordered
thera away, froth the house whereupon
the younger man seized , his child.
Mrs; Sullivan grabbed It, too. and
there ensued, a tug-of-war which wan
brought tq an end by the elder man
seizing: the. woman from behind and
forcing1 her'down upon a lounge.
It was for this act that she charged -him
with assault, declared that he
bruised, her arm.. Father and son ad
mitted they did .wrong in taking the
child the way they did. S. D. Peter
son represented the defendant and
Deputy District Attorney Keater con
ducted the case for the state;
