TREATING YOUR FRIENDS.
New angles and new contingencies,
not specifically covered in the Oregon
"prohibition law, develope hourly. The
newest, probably, is the question of
treating one's friends in his own home.
A timely news story in this connec
tion, in a Portland paper,' covers the
pomls in this connection as. follows:
In serving liquor to guests at your
home, when giving dinners and par
ties, .there is no violation of the pro
hibition law. .
Nor is it against the law to give
.liquor to someone in case of sickness.
These are two questions which
have been asked of District Attorney
Evans repeatedly since the prohibi
tion law . became operative.: Those
persons who raised the questions
pointed to the phrase dn the statute
which prohibits "giving away."
"There are two kinds of people
who want the most rigid interpreta
tions," explains Mr. Evans. "One is
the prohibitionist who doesn't want
anyone to have a drop of liquor be
cause he is opposed to it on general
principles, ine other 18 , the equally
radical wet,' who wants the' law en
forced so drastically that public senti
ment! will be aroused and bring about
its repeal. But the law is quite plain
and common sense is all that is neces
sary to interpret Ua provisions.
"Dozens of people have telephoned
or written letters wanting to know
if it isn't) unlawful for any one to
-serve liquor in his., own home to
guests, 'i The best way to answer this
is to stent with the constitution, and
then read the section which touches on,

The constitution says: ."Flroiri and1
after January 1, 1916, no intoxicating
liquors shall be manufactured or sold
- within this state,' except for medicinal
purposes upon prescription ' of a li
censed physician,' or for scientific,
sacramental or mechanical purposes."
Under section 89 of the prohibition
kw it provides that in all ' presecu
tiona under the state law or municipal
ordinances for maintaining a common
nuisance, t)he finding of liquors in the
posoanion of one not legally authorized
to sell some, except .in a . private
serving, a glass of beer to guests is

In section 15 all premises, buildings,
vehicles, boats and all other places
where intoxicating liquors are man
ufactured, sold, bartered- or given
away, in. violation of law, or where
persons are permitted to resort to the
drinking of intoxicating liquor as a
beverage, etc., are declared to be com
mon nuisances. '. : 1 .
Whr is meant by "giving away" is
defined in section 9. Here it is: "The
giving away or furnishing of intox
icating liquor for the purpose of
evading the provisions of this act, or'
any shift, device or subterfuge what
soever, to evade the provisions of
this act, shall be deemed unlawful
selling within the meaning of this
act."
To serve a guest liquor with a meal
in your own home is not "giving
away for the purpose of evading the
law." Liquor can be given away in
a manner to constitute a sale when
the giving is designed as a shift, as
a means of dodging the statute.
The constitution, which is what the
prohibition law rests on. does not say
that it is unlawful to give a guest in
toxicating liquors in your home. The
act which carries out the constitution
does not make such giving away un
lawful except where the Erivimr awav

"booze parties" this becomes an at
tempt to evade the law and is a vio
lation of section 10 and section 15,
particularly the latter, which says
where persons are permitted to re
sort for the drinking of intoxicating
liquor as a beverage." In such a case,
however, it would probably devolve on
ine neighbors to complain that a com
mon nuisance was being maintained
in the private home where the "booze
parties" were being held.
There is, according to Ir. Evans,
nothing in the law to prevent a host
from passing a glass of intoxicating
liquor to his guest in his own home.
The whole point is whether an at
tempt is (being made to evade the law,
and serving liquor ' with a meal or
in this movement are requested to be
not such a violation. t

there is a possible source of 'trouble.
