Realties Not Prosecuting, but Is in
Attendance at Trial.
Pendleton, April 8. Jim Dupuis is
on trial for alleged perjury committed
at the time of the Columbia George
trial. Judge R. S. Bean opened the
spring term of the federal court yes
terday morning and immediately
'called up the Dupuis case for trial.
Little time was lost in securing a jury
and the taking of evidence was be
gun before noon.'
Among the witnesses examined were
Jas. Beckwith, court reporter . Toy
Toy, an Indian, C. D. Dozier and An
drew Barnhardt. Others waiting to be
called were Elmer Turner, Chief of
Police Kearney, Deputy Sheriff Blake
ly and quite a number of others. .

Deputy District United States At
torney E. A. Johnson, who prosecuted
the Columbia George case, is conduct
ing the government's case today but
his Chief, Clarence L. Reames, is at
his side. Instead'of Col. J. H. Raley
defending Dupuis, James B. Perry is
conducting the defense.
Dupuis Is alleged to have testified
falsely at the Columbia George trial
in declaring that he had not seen the
accused Indian in his store on the
day of the murder. ,
Beckwith identified the records
which he had male of the testimony
in the previous trial. Toy Toy testi
fied to having been with Columbia
George in the Dupuis store on the
mornine of the day of the murder.
Dozier testified to having seen George,
Toy Toy, Andrew Barnhardt and oth
ers in1 the Dupuis store on the same
morninir and of having discussed the
incident with Dupuis following the dis
covery of the murder. Barnhart, wno
is himself to be tried at this term for
adultery, testified to having been with
the other Indians m Dupuis' store.
The defense is seeking to impeach
the government's witnesses from the
records of the Columbia George trial.
