The proposed road along the west
bank of Wallowa lake has been halt
ed by a writ of review in the circuit
court. The case is Siat of A. E. Cole
vs Wallowa county and the county
court, and the writ is to be returned
In the circuit court October I. -
' Mr. Cole's petition, verified by a
certificate of D. W. Sheahan, declares
that the county court,, when it declar
ed the L. A. Bedingfield road a pub'
lie highway, exercised its functions
"erroneously and exceeded its juris
diction to the injury of the substan
tial rights of the plaintiff." Mr. Cole
is stated to be the owner of 344 acres
of land in the vicinity of the new road.
Going back to the original petition
to the county court for the opening
of the road, Mr. Shehan and his cli
ent charge that this petition was In
sufficient because it did not specify
the beginning, intermediate and ter
minating points. They also allege
that the affidavits of posting were in
sufficient. After the road viewers had
reported in1 favor of the road, the
county court, May 8, approved this re
port and ordered the highway open on
payment, by the original petitioners.

' Joseph people subscribed the money
to pay these damages, and to" help
along the road, and the court, Au
gust 18, declared the proposed road a
public highway, ordering the district
supervisor ,to open it for travel, dam
ages .of $545 having been paid as fol
lows: D. W. Sheahan and L. F. An
derson, $150; Mary E. Stanley,' $175;
A. E. Cole, $25; Thompson & Wurz
weiler, $173 and Eliza A. Reel, $20.
In the action liow brought in the Cir
cuit court it is alleged that the dam
ices were not paid in to County Clerk
Bilyeu during the same term at which
,they were ordered paid, as required by
I law, and that the proposed road will
greatly damage plaintiff.
I Mr. Sheahan, before leaving for La
Grande on Monday, said the road
I would go a long way through nis land

! come near reimbursing him.
