Constitutionality of the fee system
required by the state water board of
applicants for irrigation water all
through the state is to be determined
in a suit against the board brought by
a big concern and yesterday the pa
pers in the case were served on Geo,
T. Cochran, who as . water commis
sioner for this district, will be made
the nominal defendant, though it is
the constitutionality the issue seeks
to determine. The suit waB filed some
time ago but on account of the absence
of the water superintendent the ser-
vice ' was not made until yesterday
when Mr. Cochran returned.
The plaintiff is the Pacific Live
stock company, a California corpora
tion, for the recovery of over $4,000
paid by the corporation as fees to Mr.
Cochran before he would file its claim
covering many hundred acres of land
in connection with the determination
of the rights of all parties on Silvies
river to water by the state , water
board. "
It is claimed that the payment was
iade under protest and was made on
ly in order to protect the company's
rights. ' The corporation claims that
the collection of the fee, which is the
regular fee esetablished by the state
water bureau, was illegal and extor
tionate, depriving it of the equal pro
tection of the laws and of its proper
ty without due process of law, and de
prived it of a right to have its rights
adjudicated without paying an exorbi
tant sum. The charging of a fee is
attacked as illegal, in addition to the
claim that the amount charged was
not a proper fee or any fee. Action is
brought to collect the fee against Mr.
Cochran personally, though the state
land board is behind him. . . .
The fee is regulated by the num-.
ber of acres in a claim, just as charg
es are made for recording instruments
by the number of words. The state
water board is expected to make vig
orous defence.

court house, La Grande, on Monday,
September 8, 1913, and publicly exam
ine the assignment roll, correct all er
rors in valuation, descriptions or qual:
ities of land, lots or other property, as
assessed by the county assessor, and it
shall be the duty of all persons inter
ested to appear at the time and place
giver.. ; .
. All persons having grievances re
garding the 1913 assessment may ap
pear before such board arid present
their affidavits containing grounds
for complaint. All such affidavits must
be presented during the first week of
