The taking jt testimony in the case
of the water users of the North Pow
der river versus the North Powder
Milling and Mercantile company,
which has been heard the past three
days by Water Commissioner James
Chlnnock in this city, was concluded
last evening and the greater number
of the attorneys, witnesses and oth,,
ers Interested in the case to the ntim
ber of about 60, took their departure
for their homes.
The testimony taken here, which
was In regard to the exact measure
ments Of the Water allotted to the
land In question and several Other
Shlall details, was so taken on the
order of the judge of the circuit
court of Unl6n county, where the
suit was instituted and then remand
ed to the board, of control to hear
this portion of the evidence which
will be incorporated into the records
of the trial. Judge Thomas N Craw
ford and Attorney H. C. Finn have
been representing the plaintiffs at
the hearing ' and Attorney Charles
Cochran has appeared for. the de-
