Sections 3245 to 3253 Inclusive, and all
amendments thereof of Lord's Oregon
Laws,' for the purpose of paying for
the Improvement of Fourth street: In
cluding all portions thereof between
the North line of Adams avenue and
the South line; of ?0" avenue in the

a resolution passed, by the council on
the 28th day of September, 1910 defin
ed it expedient and necessary) to im
prove the following portions of Fourth

proof of which "notice Is filed in the
oftlce of the. Recorder of the City of

Fourth street from 'th south line of
"0" avenue, and afterwards by an ap
propriate resolution caused the city
engineer to prepare, plans and specifications-for-
an appropriate improve
ment; and, T ,..
Whereas," said plans: and "specifica
tions were duly prepared by said en
gineer for Fourth street between the
north line of Adams avenue' and the
south line of "O" avenue, and adopted
and filed on the 28th day of Septem
ber 1910,' end ever since eaid dates
have been and now are on file In the
office of the Recorder of the City of
La Grande, Oregon: and,
' Whereas, by the adoption of said
plans and specifications on the afore
said date, said council fnim t ;n:c
to be satisfactory, and duly passes a
resolution approving ' the same, and
tbe boundaries of the districts bene
fited and to be assessed for such im
provements were fixed by resolution
as follows: :' , 1
All of the' portion of Fourth street
from the north line of Adams avenue
to the south line of "0" avenue, which
said resolution was passed on the 28th
day of September, J910; and, ? '
Whereas, said council by said reso
lution last aforesaid declored Its pur
pose to make Improvement, and on the
28th day of September, 1910 appointed
the 12th day of October, 1910 at 8
o'clock p. m., at the Council Chambers
in said city as the time and place when
and where said council would meet
for the consideration of 'written remon
strances against the making of such
proposed improvement and hearing
the cs.ua of any person feeling ag
grieved thereby; and,
Whereas, the Recorder of the City of
La Grande gave notice of the time and
.place when the Council would meet
for the consideration of, such written
remonstrances and complaints of per
sons feeling aggrieved on account of
such Improvement In the manner pre

in the city of La Grande, beginning
with the issue of the 19th of October,
1910, and ending with ' the Issue of
the 26th day of October, 1910, proof
of which Is filed in the office of the
Recorder of the City of La Grande;
on November 16, 1910. by the terms
of said notice proposals for the mak
ing such Improvements according to
th9 'plans and specifications filed in
the office of the City Recorder of the
City of La Grande were invited and
specified a time within which sealed
bids may be filed in his office for
the making of said improvement; and,
Whereas, 'within said time a bid
was received and duly accepted; and,
Whereas, ; such proceedings X were
thereafter duly had : in the premises
that an ordinance was duly and reg
ularly-passed authorizing the Mayor
and Recorder to enter into a con
tract for the improvement of said
Fourth- street .heretofore mentioned
in accordance with said plans antl
specifications; and,, i
Whereas, said work provided for in
Bald contract was completed and ac
cepted by the city of La Grande; the
Council by resolution determined the
cost of making such improvement and
duly met and considered and Com
pleted the assessment to cover the
cost of said proposed improvement
and did apportion tb costs and ex
penses of said improvement upon and
among the several parcels' of proper
ty affected and benefited thereby, and
in sq ca.se did such assessment ex
ceed such benefits, and,
" Wheveas, the said Council after
having apportioned the cast and ex
pense of such improvement upon the
property ' bounding, abutting, front
ing, , contiguous, adjacent and trib
utary to such improvement declared
the same bj ordinance and directed
the Recorder of the City of La Grande
to enter a statement thereof In the
docket of City Liens, and which or
dinance referred to is,
Ordinance No. 529, Series 1911,
entitled "an ordinance declaring the
cost of lm droving Fourth' street from
the narth line of Adams avenue to the
south line of "0" avenue, determin
ing the pioperty benefited thereby,
levying an assessment thereon to de
fray the costs and expenses of im
provement; providing for the assess
ment roll in accordance with the
assessment herein levied and to col
lect said assessment" Passed by the
council of the city of La Grande on
the 24th day of May, 1911, and ap
proved by the Mayor on the 27th day
of May, 1911; and,
Whereas, the Recorder of the City
of La Grande did thereafter enter a
statement of such assessment In the
docket of City Liens of the City of
La Grande, and gave notice thereof
to all property owners whose prop
erty Is assessed by publication there
of in five (5) issues of the city offi
cial newspaper, towit: the La Grande
Evening Observer, beginning with
the issue of the 1st day of June. 1911.
and ending with the Issue of the 6th
