ed down a decision in tbe now famon
case entitled Turner Oliver against
Fred Snyhorst, the street superintend
ent for the city of I-a Grande TV
decision is the outcome of a series of
II tela and retrial and appeals and re
appeals that have been in the legal
limelicht since 1904. and at various
times has been the seat of consider
able excitement. This was especial
ly true last spring when Turner Oli
ver defied the entire street superin
tendent's crew to proceed further
with the removal of the sidewalk and
fence in question, using bricks as
prospective weapons to make his day
all the more impressive.
The case commenced six yearn RgO
when Mr. and Mrs. Oliver were order
ed by the city council to move the
street fence and sidewalk back on the
property a distance of seven feet. Mrs.
Oliver secured an Injunction but At
torneys Finn and Knowles, represent
ing the city, moved to have several
clauses stricken from the complaint.
This was allowed by the then circuit
Judge. Alkene. The case came to trla!
on the revised complaint, and the
plaintiff refused to take any testi
mony. The city took some testimony

Is Impossible to gain further informa
tion as to the Rnckman loss. .It Is
presumed that It, too, was Ignited by
the locomotive.

Enterprise, July 13. Henry
Wright of this county, was this morn
ing convicted of perjury In connection
with his testimony when on trial last
May on a charge of bootlegging. He
swore while on the stand that he did
not sell liquor us charged, but was
convicted during the present term of
the court on a charge of perjury, hav
ing sworn falsely.
Water Case Disposed of.
Judge Knowles as circuit Judge, will
personally go to North Powder to in
vestigate the water dispute-now un
der way at that place. He granted an
order temporarily dhidinit the water
hetween the two parties in dispute
promising to personally go to North,
Powder before issuing permanent de
crees on ihe issue. This action fol
lowed oral arguments before the
court hy Attoi vs Crawford and
Cochran of Ij Grande, who represent
I ed the parties.
GIRL SHOOTS BLACKMAILER.
Plucky Daughter Avenge Father's
(old-Blooded Murder.
New Orleans. July 13. Joseph
Spiggnae, blackhand agent, today shot
and killed John Manzela, a wealthy
Syclian merchant, who had refused a
demand for money, and then was
himself shot and killed by Manzella's
daughter as he tried to escape.
Shiggnae entered Manzella's store,
whereupon Manzella refused to be
blackmailed. Spiggnae drew a revol
ver and shot the old man through the
heart and then ran. The girl, who had
heard the dispute, came to the fath
er's rescue, and shot the murderer uz
he was running down the street.

from Portland last evening. She will
open her office in connection with
the fact that the youngest actor on
the American stage, Mr. Thomas
Bruce, Jr., appears at every perform-
