. Hearing of evidence and arguments
In the trespass suit brought by Turner
Oliver against Street Superintendent
Matott and four workmen last even
ing when the street ' superintendent
tore away the sidewalk and fence on
Mr. Oliver's property In accordance
with Instructions to Btralghten - out
the street following a decision by
Judge Bean of the circuit court that
Oliver was on the street, was post
poned this morning until Monday at
10:30. The defendants who are J. A.)
Matott, J. O. Mills, I. C. Holmes, I
Harris and II. Oliver, were in attend
ance at the Justice of the peace's of
fice this morning at 9:30. when the
case'had been set for hearing, but
Mr. Oliver appeared and asked for
a stay In proceedings due to the fact
that Mrs. Oliver was overcome by the
excitement of yesterday afternoon
and needed Mr. ' Oliver's attention.
The court readily granted the reduest
and the case will come to hearing
next Monday. ,
During the time yesterday evening
that the police parlled with Mr. Oliver
the crew succeeded in tearing away
the entire sidewalk and fence.
