by ordinance the sale of intoxicating
liquors -vhen the local option law Is
In force in the county in which the
city Is situated, even , by the mo-.t

dicated that the local option law be
came an amendment to existing char
ters and ordinances In limiting their
power, "until deprived thereof in the
manner prescribed in the local option
law, enacted by the people June 6,
1904, to license, tax, t egulate or pro
hibit etc." 1. e. The city, has no right
to authorize what is prohibited by the
local optiou law, which Is commou
sense, and any one can understand it.
This does not deny the right to the '
city to pass an ordinance concurrent
with the state law. The local option
law prohibits no such thing.
; And It is not likely that our Su
preme court would e'er, put itself on
record by holding to such doctrine la
the face of the overwhelming aJJu

many atatei having laws similar to -
our own, (and t.nfch must be inter
preted by principles that we use In
courts); holding that the power to
regulate and control the liquor, traf
fic Is concurrent In both the state and

course, the city has the proper au
thority from the legislative depart
ment, which in this state Is either
from the legislature or from the peo
ple direct under the, initiative. Coa--stitutional
limitations place no such
restrictions on cities In the enact
ment of. police regulations, and they
may ? be concurrent with the penal
laws of the state. ' : '
So there seems to be little doubt
about the ; rights i of the city to
pass the ordinance in Question, and
the peole who enacted the law by an
overwhelmning majority have the
right to demand Its enforcement
without any ; Insinuations . as ; to
whether it is a good or bad law. ,
.It is the law of .the land because

Union county said so, V Every law
abiding citlxen upholds the laws of
his country. All good citizens, re
gardless ; bow they may have voted
on this question, believe In, the en
forcement of the laws of the country
by the servants i of the people who
are paid by the tax payers for that
