A petition was granted yesterday by County Judge Henry, to allow a com promise in the case of J. A. Russell vs. the O. R. & N. The case was where the plaintiff was suing the O. R. & N. for damages for the death of Mr. Russell's son, J. Donald, at Perry some time ago. The case was tried in the lower court and the plaintinff secured Judge ment to the amount of $7500. The O. Then Ito dived, grappled his opopnent and wrestled until Ito with a stranglo hold choked Robinson to submission In the second bout, the Jap again used the strangle hold and beat Robinson in three minutes. Relief Came Soon. At 9:30 this morning Chief Dispat cher Corbett prepared a bulletin to the effect that the trains would be moved about noon and in the bulletin he set out the facts of the wreck. This obliging information was partly withheld on account of unexpected progress on the scene, and instead of noon the bulletins read 10:10. No Other Damage. According to reports received in the local dispatcher's office, the cloud burst occurred in the mountainous country back of Unity, and it was only the aftermath that struck the mainline. No private property is re ported damaged. That the freak of nature did not strike a heavily pop ulated district is fortunate, for its appearance was so sudden and so ter rific that escape from canyon dis tricts would hav ebeen impossible.
