PENDLETON, Aug. 3.-A special to the East Oregouian from Pilot Rxk, says : It seems that this town's one near beer saloon is not to give up the ghost without a struggle' and the struggle is now on this afternoon. What the outcome will be remains to be seen. Yesterday was the expiration of the limit of time set by the city council for the proprietors of the Joint, Brad burn Brothers, to close rip their busi ness and move out, the council re fused to grant them a license. Having no desire to give up a lu crative business and acting on the ad vice of their attorney, Dan P. Smythe, of. Pendleton, they did not close up and move out yesterday, but continu ed to do business in the same way at the same old stand. This morning when they opened up for business they were arrested by the town marshal. Their case was set for trial at 2:30 this arteruoon and Auuniey Suijilie came out in an automobile to repre sent his clients. Though the case has not yet been tried it is understood that the conten tion of the near beer men and their attorney will be that the council has no authority to refuse to grant them a license, without cause, When they had compiled with every requirement of the law. i KllSIKAIIS. One Mon Recognizes Place by Exhibits at A.Y-P. Two sections were necessary to carry the passengers of No. 6 this morning. The first was composed of chair cars and the second was sleep ers and diners. The passengers of the second section were principally tourist on their way home from the fair. . Publicity Manager Currey was at the depot, distributing literature of the Grande Ronde valley. He disposed of 120 booklets. Mr. Currey, by hand ing the booklet telling the story of the cherries raised here, brought forth the remark from one gentleman that he recognized the place by the book let and the cherries on display in the Union county section at the A-Y-P. Mr. Currey accompanied the gentle man into the train and was introduced to five other members of the party, all business men of Oberlin, Ohio. They were all enthusiastic over the west and expressed their strong ds slre to return. Several of the tourists made known the fact that they had visited the Oregon building at the fair and were Impressed with the Union county ex hibits. All were well to do looking people and no doubt will go to their home in the east singing the praises of the western country, and no doubt some of them praising the beautiful Grande Ronde.
