Judge Wolverton of the United
States court has rendered a decision
in the famous case of the Goodnough
Mercantile Stock Company of Elgin
vs. Cecil Galloway and the First Na
tional bank of Elgin, which likely
end a case that has been in court
since 1903.
About May, 1903, G. W. Buck was
carrying on a sawmill business near
Elgin, and the G. M. & S. Co. mer
chants of Elgin, in order that he
might be able to carry on his busi
ness, entered Into a contract with
Buck by which they agreed to fur
nish him supplies with the agreement
that, that company should have a lien
on all of the timber that he should
buy, and on all the logs and lum
ber that he should cut or manufac
ture. This contract was not in wri
ting. The company furnished Buck
supplies and money to carry on the
business amounting to more than 40,
000.00, over and above what he paid
them. About May. 1903, tte First
bank of Elgin, having a claim against
Buck on an old debt of a considerable
amount, through its attorney Col.
Ivanhoe, began an action against
Buck an dattached all of his logs
and lumber, the bank claming that
the G.. M. & S. Co. had no lien on
the lumber and logs and claiming
that their pretended lien was void.
The Q. M. & S. Co. employed the
firm of Kamsey & Oliver as its at
torneys and a legal battle begau, the
company asserting its lien on th8
timber, logs and lumber of Buck.
Buck was adjudged a bankrupt by
the U. S. Court and Cecil Galloway
of Elgin was made trustee.
The company began a suit "in tne
State Circuit Court of this county be
fore Judge Eukin to foreclose their
lien. . This suit was begun against
the First bank of Elgin and Galloway
and G. W. Buck.
Ramsey fcOliver appeared as at
torneys for the G. M. & S. Co. and
J. D. Slater and Col. Ivanhoe for the
defendants. About a month was con
sumed In taking the testimony be
fore a referee.
The defendants demurred to the
complaint and claimed that the State
Court had no jurisdiction of the case.
Judge Eakin, after hearing the de
murrer argued, overruled it and held
that his court had jurisdiction. The
case was tried on its merits and
Judge Eakin decided in favor of the
company and its Hen. Then the de
fendants appealed to the Supremo
Court and the case was there tried
and that court finally held that the
State Court had no jurisdiction, and
that is was a matter foi adjudication

This left the parties where they be
gan with the hou ra in favor of the
defendants, but nouilig whatever had
been settled as to rue merits of the
matter. Then, the company began a

Court at Portland, before Judge
Wolverton. The issues were about
the same as in the State Courcs.
Mi. J. D. Slater appeared for the de
fendants, the bank and Galloway,
wh.le Ramsey & Oliver represeaccd
the plaintiff company again. Mr.
Slater had won out In the Stat3 Su
preme Court on the claim that the
State Court had no Jurisdiction
When the Co. wen into the Federal
Court the defendaiaa demurred again,
claiming, Inter alia, that the Federal
Court had no jurisdiction of thl suit.
This was considered rather strange
by the plaintiff's counsel, as the at
torneys for the defendants had claim
ed in the State Court that the U. S,
Court had " exclusive Jurisdiction of
the subject matter. However, the U.
S. Court overruled the defendants'
demurrer. The case was put at Is
sue and it was tried by agreement
on the evidence taken In the .case in
the State Court, and this case wan
argued on June 9th, 1908, in Port
land, before Judge Wolverton, by
W. M. Ramsey, for the company
plaintiff and by J. D. Slater for the
Elgin bank and Cecil Galloway, de
fendants. :
Owing to the crowded state of the
docket of the Court, this case was
not decided until last week, when
Judge Wolverton decided It In favor
of the O..M.-& S. Co., the. plalnttcs.
This matter hag been 13 Court about
six years. The first battle was won
by the plaintiffs before Judge Eakin,
and the second by the defendants In
the State Supreme Court, while the
third battle was won by the plain
tiffs In he U. S. Court
