the district attorney of the actions of
defendant regarding his appearance at
the windows. No legal steps were
taken.
It Is not a fact that defendant
loaned Mr. Cuehler J 200 nnd we gave
him a promissory note for $200, and
that I induced him to destroy it,
never heard of this note story until
after the fire. I never saw such a
note. We had all our householld goods
and clothing In the house and mr.ny
things of value destroyed. We carried
no insurance.

T. 12. Buehler said: "About 9:30
Sunday evening, January 24, I was
taking a bath and had only been In
bed a few seconds when the clock
struck 10. About 10:30 I heard a
queer noise; I spoke to my wife about
it and got up and went to my daugh
ter's room. She was asleep and all
right, and I again retired. About two
minutes later, I heard a crackling
noise, which I thought was hail, and
a little later Mrs. Buehler said she
letected smoke; we investigated and
found the house on fire under the
floor, and made the alarm, and with

I went under the house to thaw out
;hc water pipes and noticed about half
a carload of old, dry shingles. I fav
tened the door securely' to keep out
the cold. Did not see Joe' on the

destroy. Both Mr. and Mrs. Buehler
deny ever receiving either any money
or articles of value whatever from Joe
at any time, which they did not pay
him for.

deparment: 'I was there all night.
About 7:30 defendant came there and
said. 'When did this happen? What
time did it occur? If I had known It
would surely have been here. I did
not know anything about It.' 'That
was a pretty good Job you done,' and
he replied, 'Yes, It was,' .and from
there he 'ent to the v Dr. Molitor
house and barn."
He said he was not a member nf '.he
crowd who 'phoned Mrs. Zuber, or
was at the jail that night.
HaLstcn's Testimony.
Fred Haisten: Have lived In La
Irande 11 yiiars. Have known de
fendant several years; saw Joe about
9:35, corner Spring and Sixth, by mail
box. With my wife I attend Christian
church services, and was going home.
Joe Williams passed us within seven
feet on a run; there Is an electric light
at that corner; this was one block west
of Mrs. Zuber's residence, leading to
ward Fourth street, the site of the fire,
ind when I last saw him lie was on
lie corner of Fifth and Spring.

John Ruby, afied 15, was (he next
witness up. Young Kuby said. Am
in tenth grade In school and carry

fendant. I saw him standing at th
corner of the house two nights before
the fire, about 7:30 or X o'clock,

At 3:30 two important witnesses
were called. J. ,s. I'arker, jr., a
schoolboy, testified that he met the
defendant at a point near the Baptist
church, going toward Fourth street, on
the night of the fire. It was between
and 9:30 o'clock. He spoke to Wil
liams, saying "Hello. Jo,.." The negro
answered In a low voice. In cross-
examination Sparker failed to be
shaken and was corroborated In detail
by Miss Carbine, who was with Spar
ker when the meeting took place.
